Cyber Police Notice for Bank Account Freeze: Cyberabad & Rachakonda Jurisdictions

Cyber Police Notice for Bank Account Freeze: Cyberabad & Rachakonda Jurisdictions
A practical guide for borrowers, business owners, account holders and Hyderabad / Telangana clients whose accounts are frozen after a cyber complaint.
Introduction
A Cyberabad cyber crime account freeze is often the first sign that a UPI credit, NEFT, IMPS or wallet transfer into your account has been marked as part of an online fraud trail. The bank does not send a court order. It acts on a police email, NCRP alert or notice under Section 106 BNSS, and your debit card, UPI and cheque book stop working the same afternoon.
The same pattern is common under Rachakonda Cyber Crime Police Station and, separately, Hyderabad City Cyber Crime Police Station. Many clients in Gachibowli, Madhapur, Uppal, LB Nagar and Medchal-Malkajgiri discover the freeze only when salary, EMI or vendor payments bounce.
This article explains what a Section 106 BNSS freeze notice actually is, how Cyberabad and Rachakonda units handle it, what documents you need to unfreeze a bank account in Telangana, which forum to approach, and the mistakes that keep an account locked for months. Outcomes depend on facts. High Courts are not speaking with one voice on debit freeze versus lien. Those points are flagged for verification.
What a Cyber Police Freeze Notice Really Is
Police do not physically take your passbook. They treat the balance as “property” and tell the bank to stop debits, or to mark a lien on a named sum. The Supreme Court held long ago, in State of Maharashtra v. Tapas D. Neogy, that a bank account is property that can be seized during investigation. That reading now sits inside Section 106 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (old Section 102 CrPC).
Section 106 lets a police officer seize property that is alleged to be stolen, or that is found in circumstances creating suspicion of an offence. After seizure, the officer must report the fact forthwith to the Magistrate under Section 106(3). That report is the judicial hook you later use for release.
Section 94 BNSS (old Section 91 CrPC) is different. It is only a summons for documents and statements. It is not, by itself, a power to lock the account.
Section 107 BNSS is also different. It deals with attachment, forfeiture and restoration of property derived from an offence. Attachment under Section 107 needs a Magistrate’s order, with notice and a hearing. Several High Courts now say a full debit freeze is attachment, not mere seizure. Bombay High Court in Kartik Yogeshwar Chatur v. Union of India (November 2025) held that an investigating agency cannot debit-freeze an account under Section 106 and must proceed under Section 107 if attachment is needed. Allahabad High Court, including in a matter that examined a freeze notice from Cyber Crime Police Station, Rachakonda, has held that a freeze under Section 106 is possible without prior notice to the account holder, but only for the suspicious amount, and only if Section 106 is fully complied with.
Telangana High Court practice is closer to proportionality than to a blanket lock. In M/s The Bottle Restaurant and Bar (March 2026), the Court held that freezing without a prima facie nexus to a cognizable offence violates fundamental rights, and directed that only the disputed amount remain under hold. In Kanakati Naresh v. Union of India (6 May 2026), Justice Nagesh Bheemapaka held that an account cannot stay frozen indefinitely on NCRP complaints and informal emails unless the action is traceable to authority of law, and directed defreeze within two weeks. Binding effect on every later Cyberabad or Rachakonda notice still depends on the facts of your file. Treat the split as live law, not a slogan.
When Cyberabad or Rachakonda Issues the Notice
A freeze usually starts with a complaint on cybercrime.gov.in or helpline 1930. The National Cybercrime Reporting Portal pushes an alert through the Citizen Financial Cyber Frauds Reporting and Management System (NCRP–CFCFRMS). The receiving bank marks a hold. The local cyber station then issues a written or email direction citing Section 106, and sometimes Section 94.
Cyberabad Cyber Crime Police Station
Cyberabad Commissionerate covers the western IT corridor and adjoining mandals. The Cyber Crime Police Station functions from the Cyberabad Commissionerate campus at Gachibowli, Hyderabad. Public contacts commonly listed include 1930, station mobiles around 8712663454 / 9490617310, and sho-cybercrimes@tspolice.gov.in. Verify the live number and email on cyberabadpolice.gov.in before you travel. The Commissionerate site has, at times, carried an online defreeze-request form. Confirm whether that form is still live.
Rachakonda Cyber Crime Police Station
Rachakonda Commissionerate covers the eastern belt — Malkajgiri, Uppal, LB Nagar, Vanasthalipuram, Ibrahimpatnam, Bhongir and adjoining areas. Headquarters is at Neredmet, beside the Malkajgiri court complex. Cyber Crime functions from the Commissionerate. Helpline 1930 is the public number. Bankers’ coordination meetings at the Neredmet CP office in 2025 show that freeze and statement requests from this unit are frequent. Always take the exact station name, FIR or NCRP number and IO details from your bank; do not assume Gachibowli if the freeze letter says Rachakonda.
Other Telangana units that freeze the same account
- Hyderabad City Cyber Crime Police Station, Central Crime Station building, Basheerbagh.
- Telangana Cyber Security Bureau (TGCSB), DGP Office Complex, Lakdikapul — coordination and statewide cyber policy.
- Outstation cyber cells (Gujarat, Kerala, UP and others) that push NCRP alerts onto a Hyderabad account. One account can carry five freeze flags from five States.
Hyderabad City police public advisories in December 2025 said accounts get frozen when they are linked, even indirectly, to online fraud, fake investments, illegal loan apps, betting proceeds or mule activity. Accepting a transfer from an unknown person for a cash commission is treated as a mule trail, not a private favour.
Lien, Debit Freeze and Full Freeze — Do Not Mix Them Up
Ask the bank, in writing, which of these three restrictions is in force:
- Lien or hold on a named sum — the rest of the account should still work. This is what the MHA / I4C SOP of January 2026 and CFCFRMS FAQs expect as the default.
- Debit freeze — no outgoing payment, even if the disputed credit is a few thousand rupees and the balance is in lakhs.
- Full operational freeze — debit plus often UPI, net-banking and cheque, sometimes even credits.
If the bank has locked the whole account for a small disputed credit, your first written request should ask for conversion to a lien limited to that UTR. Cite the SOP and the Telangana High Court proportionality line. Whether the bank will move without a police clarification depends on that bank’s freeze desk. Flag current MHA SOP text and any RBI 60-day hold proposal (publicly discussed in September 2026) for human review before you quote them as binding rules.
Step-by-Step: How to Unfreeze a Bank Account in Telangana
Step 1 — Get the paper from the bank, not from WhatsApp
- Visit the home branch and email the bank’s nodal / freeze desk the same day.
- Demand in writing: nature of restriction (lien / debit freeze / full freeze); disputed amount and UTR; date of hold; NCRP or CFCFRMS acknowledgement; name of the police station; FIR or complaint number; IO name and official email; the exact section cited (94, 106 or 107 BNSS); whether any Magistrate order exists.
- If there are multiple flags, insist on a list of every LEA. One NOC will not lift five freezes.
Step 2 — Build the transaction file
- Account statement with the incoming credit highlighted.
- Invoice, contract, GST invoice, e-way bill, rent receipt or salary slip that explains why the money came in.
- Chat or email trail with the payer. Do not edit screenshots.
- KYC pack: PAN, Aadhaar, account opening form extract, cancelled cheque.
- If you are yourself a victim of a mule or phishing chain, the NCRP acknowledgement of your own complaint.
Step 3 — Representation to the Investigating Officer
Address the SHO / IO of Cyberabad CCPS, Gachibowli, or Rachakonda Cyber Crime, Neredmet, as the bank letter names them. Copy the jurisdictional Magistrate and the bank nodal officer. State, in plain words:
- You are an account holder, not named as accused, unless the FIR actually names you.
- The specific credit and the commercial reason for it.
- Request to confine the hold to the disputed UTR, report the seizure to the Magistrate under Section 106(3) if not already done, and issue a written unfreeze / NOC to the bank.
- Request that any attachment, if required, proceed only under Section 107 with a Magistrate’s order.
Cyberabad police have publicly restored hundreds of frozen accounts after verification and issuance of NOCs. That is an administrative practice, not a right. Keep a receiving copy.
Step 4 — NCRP–CFCFRMS grievance through the bank
The January 2026 SOP contemplates that the bank raises a grievance on the portal. Reported working timelines (verify on the live SOP): bank to raise the grievance as early as possible and not later than seven calendar days; Investigating Officer to decide, preferably after video verification, within about fifteen calendar days. If the officer refuses, reasons are to be recorded and sent to you by email or SMS.
Step 5 — Magistrate application under Sections 497 and 503 BNSS
If the police stay silent, move the Magistrate who has jurisdiction over the police station that seized the account, or the Magistrate to whom the Section 106(3) report was sent. Section 497 deals with custody and disposal of property produced before a court. Section 503 deals with property seized by police and reported to the Magistrate but not produced in a pending inquiry or trial. Ask for release of the account, or at least of the untainted balance, on conditions the court thinks fit. Carry the bank letter, the IO representation and the transaction file. Disposal timelines under Section 497 have been read by some High Courts as tight (statement within 14 days of production and an order within a further 30 days). Confirm the latest Telangana practice before promising a client a 45-day clock.
Step 6 — Writ to the Telangana High Court
A writ under Article 226 is the exceptional route when the freeze has no statutory order, no Magistrate report, no nexus to the FIR, or has continued indefinitely on portal emails. Kanakati Naresh is the local illustration. Do not file a writ as the first step while a simple IO representation or Magistrate application would do. The Court can still leave the disputed sum under hold and free the rest.
Forums and Who Does What
- Bank nodal officer and freeze desk — first source of the freeze reference.
- NCRP / CFCFRMS grievance module — bank-raised grievance to the IO.
- Cyberabad CCPS, Gachibowli — IO representation and NOC for Cyberabad flags.
- Rachakonda Cyber Crime, Commissionerate, Neredmet — IO representation and NOC for Rachakonda flags.
- Hyderabad City CCPS, Basheerbagh — if that unit issued the flag.
- TGCSB, Lakdikapul — only for coordination issues, not as a substitute for the IO.
- Jurisdictional Magistrate — Sections 497 and 503 BNSS release applications.
- Telangana High Court at Hyderabad — Article 226 writ in exceptional cases.
- DRT Hyderabad-1 / Hyderabad-2 — only if a separate SARFAESI or RDDB recovery freeze is also running. A cyber freeze is not a DRT matter.
Timelines That Actually Matter
- Golden hour for a victim of fraud: 1930 plus cybercrime.gov.in at once, so the outbound money can be marked at the next hop.
- Same day: written request to the bank for freeze particulars.
- 48–72 hours: representation to the named IO with the transaction file.
- SOP working window (verify): bank grievance in 7 days; IO decision in 15 days.
- Cyberabad public practice after an NOC: banks have said restoration often follows in about three working days. That is practice, not a statute.
- No fixed outer limit in the BNSS itself for how long a Section 106 hold may last. Indefinite freeze without review is what Telangana High Court has struck down.
- RBI’s September 2026 proposal of a 60-day outer limit on temporary debit holds was a draft framework at the time of writing. Do not treat it as notified law until the circular is issued.
Documents Checklist
- Bank freeze / lien letter and every subsequent email from the freeze desk.
- List of all LEA flags, FIR numbers and NCRP acknowledgements.
- Passbook or e-statement covering the disputed credits and the six months around them.
- Proof of source and destination of the money (invoice, contract, salary, rent, GST).
- KYC and account-opening papers.
- Your own cyber complaint, if you are also a victim.
- Representation to IO with proof of service (email + acknowledgement).
- If moving court: identity proof, vakalatnama, affidavit, and a prayer limited to the untainted balance if the disputed UTR is still in issue.
Common Mistakes That Keep the Account Frozen
- Walking into Gachibowli when the letter names Rachakonda, or the other way around.
- Asking the bank to “just lift it” without an LEA reference. The desk will not.
- Giving one story to the bank and a different story to the IO.
- Paying a private fixer who promises an NOC.
- Ignoring a Section 35 BNSS notice to appear, if one follows the freeze. Non-appearance converts a property issue into a custody risk.
- Filing a writ on day one without a paper trail to the IO and the Magistrate.
- Assuming a single NOC clears every State’s flag on the same account.
- Treating “I did not know the payer” as a complete defence when the account was rented out for commission. Police advisories in Hyderabad have said ignorance is not a safe answer in mule cases.
When You Should Consult an Advocate
Instruct counsel early if any of these is true: the freeze covers salary or working-capital accounts; you are named in the FIR; more than one State has flagged the account; the bank refuses to disclose the LEA; the IO will not confine the hold to the UTR; a Section 35 notice or a summons has also arrived; or the hold has crossed several weeks with no Magistrate report under Section 106(3). An advocate can draft the IO representation, the 497/503 application and, if needed, the writ, without mixing the cyber freeze with an unrelated SARFAESI or GST attachment.
Bullet-Point Checklist
- Read the bank SMS or returned UPI as a freeze, not a technical glitch.
- Collect the freeze reference, UTR, amount, station and section in writing.
- Separate lien from debit freeze from full freeze.
- Map the station: Cyberabad Gachibowli, Rachakonda Neredmet, Hyderabad Basheerbagh, or outstation.
- File the transaction explanation with the IO and copy the Magistrate.
- Ask the bank to raise the NCRP–CFCFRMS grievance.
- If silent, move the Magistrate under Sections 497 / 503 BNSS.
- Writ only when there is no lawful order or the freeze is indefinite.
- Do not close the account or withdraw cash in cash-heavy patterns that look like layering.
- Close unused accounts going forward so they cannot be recruited as mule rails.
Conclusion
A Cyberabad or Rachakonda freeze notice under Section 106 BNSS is a seizure of property, not a conviction. The fastest way to unfreeze a bank account in Telangana is still a complete paper trail: bank particulars, a truthful explanation of the credit, a written request to the correct cyber station, a portal grievance, and, if that fails, a focused application before the Magistrate. Keep the hold proportionate to the disputed UTR. Use the Telangana High Court when the freeze has no legal backbone. Do not bargain with unofficial intermediaries, and do not treat silence as a strategy.

Questions
Can Cyberabad police freeze my account without telling me first?
Yes, in the sense that Section 106 does not require prior notice to the account holder. Allahabad High Court has said so in 2026. The bank should still tell you after the hold is marked. The officer must report the seizure to the Magistrate forthwith. Absence of that report is a ground you can use later.
Is a notice under Section 106 BNSS the same as a Section 35 notice to appear?
No. Section 106 is about property. Section 35 is about your personal appearance during investigation. You can receive both. Do not ignore the appearance notice because you are busy with the freeze.
Can the entire account be frozen for a small disputed credit?
Several High Courts, including Telangana High Court in the Bottle Restaurant matter, have said the hold should match the suspicious amount. Bombay High Court has gone further and said debit freeze is not available under Section 106 at all. Your bank may still have locked everything. Ask in writing for a lien limited to the UTR and, if needed, take the point to the Magistrate or the High Court.
Where do I go in Hyderabad to get an NOC?
To the station named in the bank letter. Cyberabad CCPS is at the Commissionerate, Gachibowli. Rachakonda Cyber Crime works from the Commissionerate at Neredmet. Take KYC, statements and the explanation. An NOC is an administrative letter to the bank, not a court decree.
How long does it take to unfreeze a bank account in Telangana?
There is no single statutory clock. Clean files with one local flag sometimes move in two to three weeks after a complete representation. Multi-State flags take longer. Indefinite holds without a lawful order have been struck down by Telangana High Court.
Can I file a writ in the Telangana High Court immediately?
You can, but the Court expects a record of what you asked the bank and the IO. Writs work best where there is no Section 106 report, no Magistrate order, no nexus, or an endless freeze on portal emails. Kanakati Naresh (6 May 2026) is the local example.
Does a cyber freeze mean I am an accused?
Not by itself. Many freezes land on hop accounts in a layering chain. That said, mule-account allegations can become FIRs under the Bharatiya Nyaya Sanhita and the Information Technology Act. Get advice before you give a recorded statement.
Will DRT Hyderabad lift a Cyberabad freeze?
No. DRT deals with bank recovery under RDDBFI and SARFAESI. A cyber police freeze is a criminal-process hold. Use the IO, the Magistrate or the High Court.
