Banking, SARFAESI and insolvency

Related. Banking and SARFAESI · Insolvency and NCLT

Can a civil court stop or stay a SARFAESI auction?

Ordinarily, a civil court cannot entertain a suit or grant an injunction in matters that fall within the jurisdiction of the Debts Recovery Tribunal under the SARFAESI Act, 2002. A borrower or affected person in Hyderabad or Telangana may need to approach the DRT under Section 17 of the SARFAESI Act.

The correct remedy depends on the notice received, the stage of the recovery action, the relief requested and the facts of the case. Obtain legal advice immediately if an auction, possession or sale is proposed.

What should I do after receiving a SARFAESI notice from my bank?

Do not ignore the notice. Check:
- The type of notice received.
- The date on which it was issued and served.
- The amount claimed by the bank.
- The secured property mentioned.
- Whether possession or auction proceedings have begun.
- Whether any payment, restructuring or settlement proposal has been made.

Depending on the facts, possible steps may include submitting objections, examining the bank’s calculation, negotiating with the lender, approaching the DRT or seeking appropriate interim relief.

Can a bank auction my property without giving notice?

A secured creditor is generally required to follow the applicable statutory procedure and provide the notices required by law. Whether the bank complied with that procedure depends on the documents, dates and recovery stage.

Obtain and preserve the demand notice, possession notice, auction notice, sale notice, newspaper publications and proof of service. A procedural defect may require timely legal action.

Can I challenge a bank auction in Hyderabad?

A bank auction may be challengeable in an appropriate proceeding if there is a legally sustainable ground, such as procedural non-compliance, an incorrect outstanding amount, lack of proper notice or another defect recognised by law.

The appropriate forum and limitation period must be examined before filing a case. A person who receives an auction notice should not wait until after the sale without obtaining advice.

Can I file insolvency proceedings before the NCLT for an unpaid invoice?

Not merely because an invoice remains unpaid. Proceedings under the Insolvency and Bankruptcy Code, 2016 require compliance with statutory conditions, including the applicable default threshold and procedural requirements.

For an operational creditor, a genuine pre-existing dispute about the debt or liability may prevent commencement of the insolvency process. The IBC should not be used as an ordinary debt-recovery mechanism.

Can an operational creditor file a Section 9 IBC application when the company disputes the invoice?

Generally, a Section 9 application may be rejected if a genuine dispute existed before the statutory demand notice was received. The NCLT may examine contracts, purchase orders, invoices, correspondence, prior notices, payment records and other documents to determine whether the dispute is genuine.

A dispute created only after receipt of the demand notice may be treated differently, but the result depends on the evidence and facts.

What documents are needed for a SARFAESI or bank-recovery consultation?

Useful documents may include:
- The loan or facility agreement.
- Sanction letter and repayment schedule.
- Bank statements.
- Demand notice.
- Possession notice.
- Auction or sale notice.
- Documents relating to the secured property.
- Payment receipts.
- Restructuring or settlement correspondence.
- Any earlier court or DRT orders.

Bring the complete set of notices and envelopes or electronic delivery records showing when they were received.

Where is the DRT for bank recovery matters arising in Hyderabad?

Debts Recovery Tribunal matters for Hyderabad and much of Telangana are heard at the DRT having territorial jurisdiction over the account, the borrower and the secured asset. Confirm the current roster, bench and cause-list before filing. Section 17 SARFAESI applications and Section 19 Recovery of Debts and Bankruptcy Act original applications follow different procedures and clocks.

Do not file in a civil court merely because the DRT is farther from Medchal or Secunderabad.

Where is the NCLT for Hyderabad company and insolvency matters?

Company and IBC matters for Hyderabad and Telangana are generally filed before the National Company Law Tribunal, Hyderabad Bench, subject to the registered office, the nature of the proceeding and the current listing. Appeals from the NCLT ordinarily go to the NCLAT.

The IBC has short statutory clocks. Bring the demand notice, invoices, financial statements and board papers to the first consultation.

Cheque-bounce cases

Related. Cheque bounce

What should I do if my cheque has been dishonoured?

A dishonoured cheque may result in proceedings under Section 138 of the Negotiable Instruments Act, 1881, if all statutory requirements are satisfied.

Preserve the cheque-return memo, bank records, demand notice, postal tracking information, correspondence and documents showing the underlying transaction. The dates of dishonour, notice, receipt and payment opportunity are important.

What is the procedure in a cheque-bounce case?

The usual sequence involves:
- Presentation and dishonour of the cheque.
- Receipt of information from the bank about dishonour.
- Service of a statutory demand notice.
- Expiry of the prescribed payment period after receipt of notice.
- Filing of a complaint within the applicable limitation period, subject to the law on condonation where available.
- Court proceedings after the complaint is taken on file.

The exact legal position must be assessed from the bank memo, notice and case papers.

Can someone be arrested immediately for a cheque-bounce case?

A cheque-bounce complaint does not ordinarily result in automatic arrest merely because a cheque was dishonoured. The case follows a statutory court process.

The position may depend on whether a complaint has been filed, whether summons or warrants have been issued, whether the accused appeared before the court and whether any order has been passed. Do not ignore court summons.

I gave a blank cheque as security. Am I automatically guilty?

No. Issuing a blank or security cheque does not automatically establish guilt. However, describing a cheque as a “security cheque” is not by itself a complete defence.

The court may examine whether a legally enforceable debt or liability existed, the terms of the transaction, the authority to fill in the cheque, payments already made and compliance with the statutory requirements.

Can I defend a cheque-bounce case if the amount claimed is wrong?

A defence may be available if the evidence shows that the amount claimed was incorrect or that there was no legally enforceable liability for the cheque amount.

Relevant issues may include payments already made, incorrect accounts, disputed goods or services, the terms of the contract, validity of the demand notice and limitation. The entire underlying transaction should be examined rather than relying only on a technical objection.

Can a cheque-bounce case be settled?

Many cheque-bounce disputes may be resolved through settlement, subject to the stage of the case and the court’s orders. A settlement should be recorded carefully, including the payment schedule, consequences of default, withdrawal or compounding steps and treatment of pending proceedings.

Do not sign a settlement without understanding its legal and financial consequences.

Which court in Hyderabad hears a cheque-bounce complaint?

After the 2015 amendment to the Negotiable Instruments Act, territorial jurisdiction is generally with the Magistrate court that covers the payee’s home-bank branch for an account-payee cheque — not automatically the drawer’s city or the place where the deal was signed.

In Hyderabad, Cyberabad and Rachakonda the complaint must match the correct Metropolitan Magistrate or JMFC. Filing in the wrong court can lead to return or transfer and can waste the filing window.

Property and civil disputes

Related. Property and real estate · Civil litigation

Does a registered sale deed prove perfect title to a property?

No. Registration of a sale deed does not by itself guarantee perfect or marketable title.

A title review may require examination of previous conveyances, encumbrances, revenue records, possession, succession documents, court orders, development agreements, permissions and other property records.

How can I verify the title of a property before buying it?

A property title due-diligence exercise may include review of:
- The complete chain of title.
- Link documents and previous sale deeds.
- Encumbrance records.
- Revenue and mutation records.
- Approved building plans and permissions.
- Property tax and possession records.
- Succession and legal-heir documents.
- Litigation and court records.
- Development or joint-venture agreements.
- Identity and authority of the seller.

The documents required depend on whether the property is agricultural, residential, commercial, inherited, jointly owned or developed by a builder.

Can I get property title verification in Hyderabad or Medchal?

Property title verification can be carried out for transactions in Hyderabad, Medchal–Malkajgiri and other areas of Telangana, subject to the documents available and the nature of the property.

A title report should identify the documents examined, apparent ownership, encumbrances, gaps in the chain of title and issues requiring further verification. It should not be presented as a guarantee against every future dispute.

How quickly can I obtain a temporary injunction or stay order?

There is no guaranteed time period. The court may consider whether there is a prima facie case, balance of convenience and a risk of irreparable injury.

Urgency, pleadings, supporting documents, notice requirements, court workload and the opposing party’s response can affect the time taken. No lawyer can honestly guarantee a same-day stay order.

Can I stop someone from selling or transferring disputed property?

Possibly, if the facts support an appropriate civil proceeding and interim relief. The claimant may need to show a legally recognisable interest, an arguable case and an immediate risk of prejudice or irreversible harm.

Important documents may include title records, agreements, possession evidence, notices, photographs, payment records and proof of the proposed transfer.

What can I do if someone is occupying my property illegally?

The appropriate remedy depends on the nature of possession, title, previous relationship between the parties and the evidence available. Possible proceedings may include a suit for possession, injunction, declaration or other relief.

Do not use force or threaten the occupant. Collect title documents, possession records, photographs, communications and information about the date and manner of occupation.

Do I need a lawyer to review a sale agreement before signing?

Legal review is advisable where the transaction involves substantial value, unclear title, instalment payments, a builder, joint ownership, a power of attorney, inherited property, development rights or an existing loan.

The agreement should clearly address title, payment, possession, registration, taxes, encumbrances, default, refund, indemnity and dispute resolution.

What records should I check for land in Medchal–Malkajgiri or Hyderabad?

In Telangana, a practical check often includes the registered deed chain, encumbrance certificate, Bhu Bharati / record-of-rights extract, mutation, tax receipts, layout or building permissions, prohibited-list / Section 22-A status at the Sub-Registrar, and any HYDRAA, FTL or buffer-land issue if the plot is near a water body.

Government poramboke, assigned land and lake-buffer land raise different remedies from a private trespass. Do not treat a single online extract as a complete title report.

What should I do if my land in Hyderabad or Medchal is encroached?

Identify first whether the land is private or government land. Private occupation may require a civil suit, injunction and, in some cases, a police complaint for criminal trespass. Occupation of government land, poramboke or lake buffer can attract Collector or Tahsildar action under the Telangana Land Encroachment Act, 1905, and related proceedings.

Do not attempt a self-help eviction. Preserve survey numbers, photographs, revenue extracts and the date you first knew of the occupation.

Criminal law, FIR and bail

Related. Criminal law

I received a police notice. Do I have to appear at the police station?

Do not ignore a lawful police notice. Read it carefully and identify whether you are being called as a witness, a person acquainted with the facts or a person accused of an offence.

If the notice concerns allegations against you, obtain legal advice before responding. Carry identification and relevant documents, do not fabricate facts and do not sign documents you do not understand.

What should I do if an FIR has been registered against me?

Obtain a copy of the FIR or reliable details of the allegations. Identify the offences invoked, assess the risk of arrest, preserve relevant evidence and avoid contacting or threatening the complainant or witnesses.

Depending on the facts, possible legal steps may include anticipatory bail, representation before the investigating agency, regular bail, discharge at the appropriate stage or proceedings for quashing where legally maintainable.

Can I get anticipatory bail in a non-bailable offence?

Anticipatory bail, also called pre-arrest bail, is not automatic. Under the current criminal procedure framework, Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 deals with directions for grant of bail to a person apprehending arrest.

The court may consider the seriousness of the allegations, the applicant’s role, the possibility of absconding or influencing witnesses, the need for custodial interrogation, previous conduct and other case-specific factors.

An application should be prepared from the actual FIR and case papers rather than by copying an old Section 438 of the CrPC format.

What is the difference between regular bail and anticipatory bail?

Anticipatory bail is sought before arrest when a person reasonably apprehends arrest. Regular bail is generally sought after arrest or when the accused is in custody, subject to the applicable procedure.

The correct remedy depends on the FIR, the alleged offences, the stage of investigation and any previous court orders.

Do the IPC and CrPC still apply in India?

The answer depends on the date of the alleged offence, the applicable transitional provisions and the procedural stage of the case.

The Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita and Bharatiya Sakshya Adhiniyam came into force on 1 July 2024. The date of the alleged offence should be identified before relying on an old or new section number.

Can an FIR be quashed?

In appropriate cases, a person may seek quashing of criminal proceedings before the High Court when the allegations do not disclose an offence, the proceeding is legally barred, the case is manifestly abusive or another recognised ground is established.

Quashing is not automatic merely because the accused disputes the allegations. The FIR, supporting material and legal grounds must be carefully examined. In Telangana, such petitions are ordinarily filed before the High Court for the State of Telangana at Hyderabad. The current provision is Section 528 BNSS, not the old Section 482 CrPC.

What should I do if the police threaten to arrest me?

Do not abscond, destroy evidence or threaten anyone. Obtain the FIR or complaint details, consult a criminal lawyer immediately and assess whether anticipatory bail or another remedy is appropriate.

The correct response depends on the alleged offences, the stage of investigation and the circumstances of the case.

Which police commissionerate covers Medchal and Hyderabad?

Hyderabad, Cyberabad and Rachakonda are separate commissionerates. Medchal–Malkajgiri matters often fall under Cyberabad, but the FIR, the police station named on the notice and the actual place of occurrence decide the station and the court. Do not assume that a Hyderabad City station can take a Cyberabad FIR, or the reverse.

Read the notice and the FIR header before appearing.

Family law, divorce and maintenance

Related. Family law

How is maintenance calculated in India?

There is no fixed percentage or universal formula for calculating maintenance. Courts may consider the needs of the claimant, income and financial capacity, standard of living, liabilities, dependants, medical needs, children’s expenses and other circumstances.

Financial disclosure and reliable evidence of income can materially affect the outcome.

Can a wife claim maintenance from her husband?

Eligibility depends on the applicable statute and facts. Potential remedies may arise under personal law, the Hindu Marriage Act, the BNSS, the Protection of Women from Domestic Violence Act or another applicable law.

The court may consider income, independent earnings, prior orders, conduct, living arrangements, children’s needs and other relevant circumstances.

Can a husband also claim maintenance?

In some circumstances, a husband may have a maintenance claim under the applicable personal law or statutory framework. The answer depends on the provision invoked, the parties’ financial circumstances and the evidence.

Maintenance law is not determined solely by gender; the applicable statute and facts must be examined.

Can we file a mutual-consent divorce immediately?

Not in every case. For a Hindu marriage under Section 13B of the Hindu Marriage Act, the parties generally must have lived separately for at least one year, mutually agreed to dissolve the marriage and satisfied the other statutory requirements.

The parties must also resolve or place before the court issues such as maintenance, custody, property and pending cases where applicable.

Can the six-month waiting period in a mutual-consent divorce be waived?

In appropriate cases, the court may consider waiver of the six-month period under Section 13B(2) of the Hindu Marriage Act in accordance with the principles laid down by the Supreme Court.

Waiver is not automatic. The period of separation, settlement of disputes, custody and financial arrangements, chances of reconciliation and other circumstances may be considered.

How long does a mutual-consent divorce take?

The time depends on the court, statutory requirements, waiting-period issues, completeness of documents, settlement terms and whether both parties remain consenting.

No responsible lawyer can guarantee a fixed completion date. A proper consultation can identify likely procedural steps and possible delays.

Can a spouse claim maintenance if they are employed?

Employment does not automatically bar or guarantee maintenance. The court may consider actual income, financial needs, standard of living, liabilities, children’s expenses and other relevant circumstances.

Evidence of income should be disclosed accurately.

Who gets custody of a child after divorce?

The child’s welfare is the primary consideration. Courts may examine the child’s age, education, health, relationship with each parent, safety, stability and the ability of each parent to provide care.

Custody and visitation arrangements can be negotiated or determined by the court according to the child’s best interests.

Which family court in Hyderabad or Secunderabad will hear my case?

Family Court jurisdiction in Hyderabad and Secunderabad depends on residence, the last shared household, where the marriage was solemnised and the relief sought. Medchal–Malkajgiri matters may go to the Family Court or District Court having territorial jurisdiction over that district rather than automatically to a Hyderabad city Family Court.

Bring address proof, the marriage certificate and any earlier orders so the correct court can be identified before filing.

How do I check my case status online in Hyderabad or Telangana?

District and taluka matters can usually be checked on the eCourts services portal or the eCourts mobile application using CNR, party name or case number. High Court matters are listed on the High Court for the State of Telangana cause-list and case-status pages. NCLT matters are on the NCLT e-filing portal.

Online status is a convenience. It is not a certified copy and it can lag behind the physical record. Confirm listing dates from the court or your advocate before you travel.

What is the usual limitation period for a civil money claim in Telangana?

Many simple money claims are governed by a three-year period under the Limitation Act, 1963, but the starting point and the Article depend on the prayer — contract, accounts, cheque, declaration or possession. Possession and title suits often have a twelve-year clock. Acknowledgement in writing and part-payment can start a fresh period.

Limitation is fatal if missed. Count from the papers, not from memory.

How do I reply to a legal notice received in Hyderabad?

Read the notice, the statute it cites, the deadline and the address for reply. Do not ignore it, and do not admit facts you will later need to deny. A reply should be based on documents, dates and the actual legal relationship — not on anger or a WhatsApp summary.

Keep the envelope, tracking and a copy of what you send. A notice is not a decree. Silence can still matter for limitation and for later pleadings.

Can I file a consumer complaint in Hyderabad?

If you are a consumer and the dispute is a consumer dispute under the Consumer Protection Act, 2019, a complaint may lie before the District Commission, the State Commission or the National Commission according to the value and the opposite party’s location. Hyderabad and Medchal–Malkajgiri have designated consumer commissions.

A consumer case is not a substitute for a title suit, a SARFAESI challenge or a commercial recovery of Specified Value. Match the forum to the statute.

What should I do after a GST or income-tax notice in Hyderabad?

Note the section, the assessment year or tax period, the date of service and the response deadline. Preserve the portal download, the DIN or document identification, and the underlying returns and ledgers. Do not treat every notice as a final demand.

GST and income-tax have their own appeal routes, pre-deposits and limitation. A writ before the Telangana High Court is not the first remedy in an ordinary quantum dispute.
