Practice
Property and real estate

Property disputes in Telangana sit at the intersection of the Transfer of Property Act, 1882, the Registration Act, 1908, the Limitation Act, 1963, revenue records, and — for apartments and layouts — special local and development-law. SN Law Chambers assists with title review before a purchase, with suits for declaration and injunction, and with possession and partition claims. A sale deed is only as strong as the chain behind it. The chambers will not certify a title on a photocopied deed and a verbal assurance from a broker.

Scope of work
- Pre-purchase title review of the documents the client actually produces
- Suits for declaration, injunction, possession, partition and specific performance of agreements of sale
- Advice on registration, stamp duty and the effect of an unregistered instrument
- Builder-buyer disputes that are civil in character, including where a consumer proceeding is the better forum
- Revenue-record discrepancies as they affect civil title, without pretending that a legal notice rewrites the pahani
Typical issues
- Whether the vendor had a transferable title, and whether earlier transfers were validly stamped and registered
- Pending attachments, mortgages, family claims and layout irregularities
- Whether an agreement of sale is specifically enforceable under the Specific Relief Act, 1963 as amended
- Adverse possession — a narrow, strictly proved plea, not a casual claim after a few years of occupation
- Who is in actual possession, and what the injunction should restrain
Applicable Indian statutes
Transfer of Property Act, 1882
Sale, mortgage, lease, gift and the rights they create.
Registration Act, 1908
Compulsory registration of many immovable-property instruments.
Specific Relief Act, 1963
Specific performance and injunctions relating to property.
Telangana Rights in Land and Pattadar Pass Books Act, 2020
Revenue records in the State. A passbook is evidence of a kind; it is not a substitute for a complete title chain.
Real Estate (Regulation and Development) Act, 2016
Where the project is registered and the dispute is of a kind the Act covers.
Procedure
A property brief starts with a document list, a chronology, and a map or layout if one exists. Notices may be issued to restrain interference. A suit for injunction without a prayer for declaration of title can fail where title is clouded. Local inspection, revenue extracts and encumbrance certificates take time; they should be obtained before, not after, a hasty filing. For builder-buyer claims, RERA, the consumer commission and the civil court are different forums with different limitation and relief. The choice is a legal one.
Typical legal remedies
- Declaration of title and recovery of possession
- Temporary and perpetual injunction
- Specific performance of an agreement of sale, or damages in the alternative
- Partition and separate possession
- RERA or consumer relief where those forums have jurisdiction
Documents commonly relevant
- Parent deeds, link documents and the latest sale deed
- Encumbrance certificate for a sufficient period
- Pattadar passbook, title deed, and revenue extracts
- Approved layout, building permission and occupancy records where relevant
- Tax receipts and electricity or water connections as evidence of possession
- Agreement of sale, receipts of consideration, and bank trail
Important considerations
- Family arrangements and GPA sales have a long litigation history in Hyderabad. They need extra care, not extra optimism.
- A legal opinion is only as complete as the documents shown. Undisclosed litigation will not appear in the opinion.
Questions
Is a registered sale deed conclusive proof of title?
Registration proves that the document was executed and registered. It does not prove that the vendor had title, or that earlier links are sound. Title is a chain.
Can I get an injunction the same week someone tries to dump material on my land?
Urgent injunctions are possible on a strong prima facie case and clear possession papers. They are discretionary. The court may also order notice to the other side. Bring photographs, revenue records and the deed.
