Succession and Mutation of Agricultural Land in Telangana: ROR Act, Bhu Bharati Rules & Legal Heir Pattadar Passbook

Introduction
Succession and Mutation of Agricultural Land in Telangana: ROR Act, Bhu Bharati Rules & Legal Heir Pattadar Passbook
Agricultural land mutation in Medchal and the rest of Telangana is no longer a Dharani-era paperwork puzzle. After a pattadar dies, legal heirs must get their names into the Record of Rights and a fresh pattadar passbook. That update is what banks, buyers and the revenue office treat as the working proof of ownership.
The governing law is now the Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (Act No. 1 of 2025), read with the Bhu Bharati Rules, 2025 notified in G.O.Ms.No.39, Revenue (Land Administration-1), dated 14 April 2025. The Telangana Rights in Land and Pattadar Pass Books Act, 2020 stands repealed. Succession and will-based mutation sit in Section 7 of the 2025 Act. Applications go online on the Bhu Bharati portal.
This guide explains when succession mutation applies, what documents you need, how the Tahsildar process works in districts such as Medchal-Malkajgiri, what happens if heirs disagree, which appeals exist, and when you still need a civil suit or an advocate.
What succession mutation actually changes
Mutation is only an amendment of the Record of Rights. It records who the revenue department will treat as pattadar after a death, a will, a partition, a sale or a court order.
It does not, by itself, decide a disputed title. Section 11 of the Bhu Bharati Act says an entry in the Record of Rights is presumed correct until the contrary is proved. If two branches of the family claim the same survey number, the Tahsildar can still refuse or split the entry after enquiry. A civil court can still try title.
What mutation does give you, in practice:
An updated ROR / pahani extract in the heirs’ names.
A new or updated Pattadar Passbook-cum-Title Deed.
Ability to mortgage, sell or gift without the deceased’s name blocking registration.
A cleaner paper trail for bank loans and the next generation’s succession.
Leaving the deceased’s name on the passbook is how families later lose auctions, face double-sale disputes, or get stuck when a sibling sells a “share” that was never mutated.
The law in force: from old ROR Acts to Bhu Bharati
Telangana land records have passed through three statutes that readers still mix up:
The older Record of Rights / Pattadar Pass Books framework (1971, as adapted in Telangana).
The Telangana Rights in Land and Pattadar Pass Books Act, 2020 (Act 9 of 2020) and the Dharani portal.
The Telangana Bhu Bharati (Record of Rights in Land) Act, 2025, which repealed the 2020 Act and moved services to bhubharati.telangana.gov.in.
Pending applications filed under the 2020 Act were not automatically finished. Telangana High Court orders in 2025 — including Smt. Saluvala Sugunamma v. State of Telangana, W.P. No. 16540 of 2025 — have directed applicants to file a fresh application on the Bhu Bharati portal in the prescribed format. If you still hold only a Dharani or MeeSeva transaction ID from 2021–2024, treat that as history and re-apply under Section 7. Confirm the current portal status of any old ID before you assume it is live.
Section 2 of the 2025 Act treats inheritance and succession — intestate or testamentary — and a will as recognised modes of mutation, along with sale, gift, mortgage, exchange, partition, court decree, Lok Adalat award and revenue-court orders.
When Section 7 applies
File a Section 7 succession or will mutation when:
The recorded pattadar has died intestate (no will), and legal heirs want the land split or held jointly.
There is a will and the beneficiaries want the Record of Rights changed.
The family already agrees on shares and only the passbook is outdated.
Assigned land is involved and the portal module for “succession including assigned lands (with or without PPB)” is the correct service — subject to the Telangana Assigned Lands (Prohibition of Transfers) Act, 1977.
Section 7 is not the right box if the change is really a registered sale, gift, mortgage, exchange or partition of a living pattadar. Those follow Section 5 (registration-linked mutation). Court-decree and “other” mutations generally go under Section 8 to the Revenue Divisional Officer, not the Tahsildar.
Non-agricultural and abadi / gramakantam mutations after death follow municipal or panchayat law (GHMC Act, Municipalities Act, Panchayat Raj Act), not the agricultural Section 7 workflow. If Medchal land has already been converted or sits inside a municipality, do not use the agricultural succession module blindly.
Who is a legal heir for agricultural land
Bhu Bharati does not rewrite personal law. It only records the persons who already acquired rights.
Hindus, Buddhists, Jains and Sikhs: Hindu Succession Act, 1956, as amended in 2005. Daughters are coparceners. Married daughters and children of a predeceased daughter cannot be left off a joint statement just because they live in Hyderabad or outside the village. Vineeta Sharma v. Rakesh Sharma (2020) 9 SCC 1 is the governing Supreme Court position on daughters’ coparcenary rights.
Muslims: Muslim personal law. Shares are not equal in the Hindu sense. A joint statement that pretends otherwise will collapse at enquiry or in a later suit.
Christians and others governed by the Indian Succession Act, 1925: follow that statute, and a will if validly executed.
Will cases: the will must be capable of being acted upon. An unregistered will is not automatically invalid, but the Tahsildar will notice objections, and a serious challenge usually belongs in a civil court, not only on the portal.
Minors cannot be cut out by a parent’s “relinquishment” on a portal form. If a minor’s share is involved, get proper legal advice before anyone signs a joint agreement.
Documents needed for legal heir mutation and pattadar passbook
Keep scans ready before you open the Mutation Modules tab. Typical set for a Medchal or Telangana agricultural succession file:
Death certificate of the pattadar.
Family member certificate / legal heir certificate issued by the competent revenue authority.
Joint statement / joint agreement of all legal heirs, with individual shares (mandatory for intestate succession under Section 7).
Old pattadar passbook-cum-title deed, if one exists.
Latest pahani / ROR 1-B extract and khata number.
Aadhaar and mobile number of each participating heir.
Will, if the claim is testamentary, plus proof of execution where available.
Survey / sub-division map — compulsory from the date notified under Section 7(1).
Proof of relationship where names differ (ration card, Aadhaar linkage, school records).
Encumbrance certificate if a bank charge or sale is pending.
For assigned land: assignment proceedings and any permission history under the 1977 Act.
The official Bhu Bharati user manual for “Application for Succession” asks you to fetch land by passbook number, or by district, mandal, village, survey / sub-division and khata, then mark the exact extent and the year or date of death.
Fees are prescribed in Schedule-B to G.O.Ms.No.39. Public summaries list a per-acre / per-gunta mutation charge, a separate passbook fee (often cited as Rs 300) and an appeal fee (often cited as Rs 1,000). Portal convenience amounts published on private sites vary. Verify the live fee on the payment screen and in the current Schedule before you pay. Do not pay cash to a private agent.
Step-by-step: succession application on Bhu Bharati
Register or log in as a citizen on bhubharati.telangana.gov.in with mobile OTP.
Open Mutation Modules and choose Application for Succession including assigned lands (with or without PPB).
Fetch the holding with the existing passbook number, or with District–Mandal–Village–Survey / Sub-division–Khata.
Select the extent that will move to the heir(s). Enter the date or year of death.
Add every family member. If an heir already holds a Telangana passbook, fetch that number too.
Download the joint agreement of all legal heirs, get it signed as required, and upload supporting documents.
Pay the prescribed fee on the gateway. Save the receipt and application number.
Book a slot from the citizen dashboard and attend the Tahsildar’s office on the allotted date with originals.
After filing, the Tahsildar must issue written notice to every person already on the Record of Rights and to others who appear interested, and publish the proposed amendment in the prescribed manner (Section 7(3)).
Objections are considered. An enquiry follows as prescribed in Rule 7 of the 2025 Rules.
The Tahsildar then amends the Record of Rights or refuses, with reasons. A refusal cannot be passed without giving the applicant a chance to represent (Section 7(2) proviso).
If no order is passed within the prescribed period, Section 7(2) treats the Record of Rights as deemed amended. The exact number of days lives in the Rules — verify the current Rule 7 timeline before you rely on “deemed mutation.”
Collect or download the updated extract and apply for issue or re-issue of the Pattadar Passbook-cum-Title Deed under Section 10.
Press reports of a May 2025 amendment say that if no objection arrives in the notice window, the Tahsildar may complete mutation without sending the file to a higher officer, and that files of claimants without a passbook may go to the RDO. Treat that as an operational change. Confirm the live Rule or circular at the Medchal or concerned Tahsildar office. Flag for human review if your file is a no-PPB case.
Medchal-Malkajgiri and Hyderabad-ring practice
For land in Medchal, Shamirpet, Keesara, Ghatkesar, Kapra, Quthbullapur, Dundigal, Medipally and other mandals of Medchal-Malkajgiri:
First officer: Tahsildar of the village’s mandal.
First appeal on a Section 7 order: Revenue Divisional Officer of the division.
Next statutory rungs: District Collector, Medchal-Malkajgiri, then the Land Tribunal.
Until a Land Tribunal is notified for the area, Section 14 treats the Commissioner / CCLA as the Tribunal.
Title fights still go to the competent civil court (pecuniary and territorial jurisdiction under the Telangana Civil Courts Act — verify the current band).
Inaction or a process that ignores the statute can still reach the Telangana High Court under Article 226, but the High Court often sends the party back to the portal or the statutory appeal.
Urban-edge survey numbers around Kukatpally, Uppal and Medchal are frequently disputed as “still agricultural” versus converted. Classification errors are a separate problem from heirship. Do not assume a succession click will also fix a wrong land-use entry.
Appeals, limitation and when civil court still matters
Section 15 of the 2025 Act is the appeal map. For a Tahsildar or Sub-Registrar order that makes or refuses an amendment under Section 7(2), the first appeal lies to the RDO.
| Order you are challenging | First appeal | Time | Next step |
|---|---|---|---|
| Tahsildar / Sub-Registrar under s.7(2) or specified s.5 clauses | Revenue Divisional Officer | 60 days from communication | Second appeal to District Collector in 30 days; Collector’s decision is final on that limb |
| RDO order under s.6(2) or s.8(2) | District Collector | 60 days from communication | Second appeal to Land Tribunal in 30 days; Tribunal decision is final and conclusive |
| Decision on Bhudhaar (s.9) or PPB (s.10) | RDO | 60 days from communication | Second appeal to Collector in 30 days |
Count limitation from the date the order is communicated, not from the date you heard about it in the village. File with the prescribed appeal fee. Rules also speak of revision; check Rule 14 and Rule 15 of G.O.Ms.No.39 for the exact revisional officer on your fact pattern.
There is no useful “limitation holiday” for sitting on an unmutated holding. Appeals are short. Title suits follow the Limitation Act, 1963 (often Article 65 for possession based on title, or other articles depending on the prayer). Third-party buyers and banks who rely on the existing passbook become harder to unwind with every year of delay.
A writ to the Telangana High Court is exceptional. Use it for admitted inaction after a complete online filing, or for a decision that ignores notice and enquiry rules — not as a substitute for the 60-day RDO appeal.
Civil court remains the forum when:
Heirs do not agree on shares.
A will is alleged to be forged or obtained by undue influence.
A stranger is already on the passbook.
You need a declaration, partition decree or recovery of possession.
Assigned-land restrictions or a prohibited transfer is in issue.
Revenue mutation cannot replace that suit.
Assigned land, wills and other high-risk files
Assigned land can appear in the succession module, but the 1977 Assigned Lands Act still restricts sale and many transfers. An heir may succeed as assignee-heir and still be unable to sell. Get the assignment file read before you promise a buyer a clean title.
A will that surfaces only after objections are invited will usually stop a quiet Section 7 order. The Tahsildar is not a probate court.
Sada bainama / unregistered-sale regularisation is Section 6, not Section 7. The two are routinely mixed up. Section 6 has its own eligibility, including a pre-2 June 2014 cut-off and a closed 2020 application window in the statute as enacted. Do not use a succession form to launder an old plain-paper sale. Fresh Section 6 eligibility should be verified on current circulars before anyone files.
Bank charges recorded on the deceased’s passbook do not vanish because heirs applied. Clear or disclose the mortgage.
Common mistakes that stall legal heir mutation
Filing without every Class-I heir, especially married daughters.
Using an old Dharani grievance number instead of a fresh Bhu Bharati Section 7 application.
Treating mutation as a final title decree.
Skipping the joint statement in an intestate case.
Ignoring the notice and objection window, then discovering a cousin has filed objections.
Uploading a death certificate that does not match the pattadar’s name on the pahani.
Applying the agricultural module to GHMC or municipal property.
Missing the 60-day first appeal.
Paying an agent in cash “to get the slot.”
Assuming deemed mutation without checking that the ROR actually changed.
Practical checklist
Confirm the land is agricultural and the deceased is the recorded pattadar on the latest ROR.
Collect death certificate, family member / legal heir certificate, old PPB, pahani and Aadhaar of all heirs.
Map heirs under the correct personal law. Include daughters.
Draft and sign the joint statement with shares. Do not leave a minor’s share to an informal waiver.
File on bhubharati.telangana.gov.in → Mutation Modules → Application for Succession.
Pay only the portal fee. Save application number and receipt.
Book the Tahsildar slot and carry originals.
Watch the notice and objection period. Answer objections in writing.
After the order, download the ROR and apply for the new pattadar passbook-cum-title deed.
If refused or wrongly split, diary the 60-day RDO appeal.
If title is disputed, file the civil suit; do not wait for the portal to decide ownership.
For Medchal-Malkajgiri holdings, name the correct mandal Tahsildar and the correct RDO division.
Conclusion
Succession mutation of agricultural land in Telangana is now a Section 7 Bhu Bharati process: online application, joint statement of legal heirs, Tahsildar notice and enquiry, then an updated Record of Rights and pattadar passbook. In Medchal-Malkajgiri and the Hyderabad ring, the file still turns on the local Tahsildar and RDO, not on a Collector-level Dharani queue.
Do the joint statement properly, include every heir the personal law recognises, meet the 60-day appeal clock, and do not confuse a passbook entry with a title judgment. Where the family is already split, start the civil case instead of waiting for the portal to invent a compromise.

Questions
Is agricultural land mutation in Medchal still done on Dharani?
No. The live system is Bhu Bharati. The 2020 Act that powered Dharani is repealed. Use bhubharati.telangana.gov.in and Section 7 for succession.
Can one son apply for legal heir mutation without his sisters?
Not safely. Section 7 expects a joint statement of legal heirs in intestate cases. Leaving out a daughter is a standard ground for objection, refusal and a later partition suit.
How long does succession mutation take?
The Act requires the Tahsildar to decide within the time prescribed by the Rules, and creates a deemed-amendment consequence if that time lapses. Working time on the ground is often several weeks after slot and notice, longer if someone objects. Verify the current Rule 7 clock.
Does a new pattadar passbook prove I am the sole owner?
It is strong revenue evidence and carries a statutory presumption under Section 11, but it is not a substitute for a title decree if another heir or a buyer is already in court.
What if the Tahsildar does not pass any order?
Section 7(2) speaks of a deemed amendment after the prescribed period. Still download the ROR and confirm the names actually moved. If the record is frozen, use the statutory appeal or representation route and, if needed, a writ for inaction.
Where do I appeal a Medchal succession rejection?
First appeal against a Section 7 Tahsildar order lies to the RDO within 60 days of communication. The next rung on that limb is the District Collector within 30 days. Keep the communication memo; limitation runs from that date.
Can NRI or out-of-station heirs complete the process?
They can join the online application and execute the joint statement through a properly stamped power of attorney. Slot attendance and enquiry notices still have to be managed. A vague WhatsApp “consent” is not a joint statement.
Is a court succession certificate mandatory?
Not as a routine Section 7 document for agricultural ROR mutation. Revenue offices usually want a family member certificate plus the joint statement. A succession certificate is a different instrument, used mainly for debts and securities. If heirs are fighting, a civil declaration or partition decree is what actually settles title.
