Execution of Arbitral Awards under Section 36 in Telangana Civil Courts
A practical guide for award-holders, businesses, borrowers and litigants in Hyderabad, Medchal and across Telangana
Introduction
Winning an arbitral award is only half the work. Money comes in when you enforce it. Under Section 36 of the Arbitration and Conciliation Act, 1996, a domestic award is enforced in the same manner as a civil court decree. In practice that means an execution petition under Order 21 of the Code of Civil Procedure, 1908 — including attachment of a bank account — before the right Telangana court.
This guide is for award-holders, borrowers who lost an arbitration, business owners and litigants in Hyderabad and Medchal. It covers when an award becomes executable, which court to approach, how a Section 34 challenge affects execution, what documents you need, and the mistakes that stall recovery.
The central point after the 2015 amendment: filing a Section 34 petition does not, by itself, stop enforcement. The Supreme Court reaffirmed this in Popular Caterers v. Ameet Mehta, 2025 INSC 1354.
This article deals with domestic awards. Foreign awards follow a different path under Sections 47 to 49. Do not mix the two. Forum mapping, court-fee and stamp-duty on awards should be verified against the latest eCourts / High Court notifications before filing.
When can you enforce a domestic award?
A domestic award can be enforced under Section 36 once the time to apply under Section 34 to set it aside has expired. If a Section 34 petition is already on file, the award remains executable unless the court grants a stay on a separate application under Section 36(2) and 36(3).
The 2015 amendment ended the old automatic stay. BCCI v. Kochi Cricket confirmed that the amended Section 36 applies even to pending challenges. Popular Caterers (18 November 2025) went further: an unconditional stay of a money award is rare. Outside the statutory fraud-or-corruption proviso in Section 36(3), the award-debtor normally has to deposit the principal or a substantial part of the award.
Practical consequence for Hyderabad and Medchal clients: if you hold the award and there is no stay order on record, you can file the execution petition. Do not wait for the Section 34 case to finish.
Which court executes the award in Telangana?
Section 36 says the award is enforced “as if it were a decree.” It does not create a new court. You file an execution petition where a money decree could be executed — typically where the award-debtor lives, carries on business, or has attachable assets.
The Supreme Court in Sundaram Finance Ltd. v. Abdul Samad (2018) held that you need not first file in the seat court and then seek a transfer. You may go straight to the court that can reach the assets.
For Hyderabad and Medchal practice, the usual forums are:
Commercial Court at Hyderabad, or the Commercial Court, Ranga Reddy District at L.B. Nagar, where the dispute is a commercial dispute of specified value.
City Civil Court, Hyderabad, for non-commercial matters or where commercial-court mapping does not apply.
District Court / Senior Civil Judge at Medchal-Malkajgiri, when the judgment-debtor’s land, office or bank relationship sits in that district — the practical home of an arbitral award execution petition in Medchal.
Commercial Division of the Telangana High Court in defined international-commercial-arbitration situations. In Tecnimont S.p.A. v. Nagarjuna Fertilizers (June 2025) the High Court accepted that an execution petition can lie before it on those facts. Verify seat, nature of arbitration and the pending Section 34 forum before choosing the High Court.
Specified value under the Commercial Courts Act, 2015 is ₹3 lakh and above. The Telangana High Court in Janset Labs Pvt. Ltd. v. Agilent Technologies (22 September 2025) held that this ₹3 lakh threshold applies in Telangana without a separate State notification. Pecuniary banding of a particular commercial court under Section 3(1A) is a different question — confirm the live notification and territorial chart before you file.
If the award-debtor’s only useful asset is a current account operated from a Hyderabad or Medchal branch, that is often enough to found execution there. The Telangana High Court in the Rashmi Metaliks line treated bank accounts accessible from Hyderabad as a sufficient hook for the Commercial Court.
Wrong forum wastes months. Match the asset, the specified-value test and the current commercial-court map. Territorial charts change — verify on eCourts before numbering the EP.
How a Section 34 challenge affects execution
Three rules matter on the ground:
Filing Section 34 does not freeze the award.
- Stay requires a separate application under Section 36(3).
Unconditional stay is exceptional.
Popular Caterers and Lifestyle Equities C.V. v. Amazon Technologies Inc. (2025) treat a money award like a money decree. Unconditional stay is generally reserved for a prima facie case of fraud or corruption (second proviso to Section 36(3)), or for an award that is egregiously perverse, patently illegal or facially untenable. In ordinary money awards, courts commonly insist on deposit of the principal, sometimes with interest.
Award-holders should still search the Section 34 docket and annex a short affidavit that no stay is in force. Award-debtors who need time must move the stay application at once, with a realistic deposit proposal. Hoping that “the challenge is pending” will not stop attachment.
A Section 37 appeal against a Section 34 order also does not automatically stay execution. Separate stay is required.
Step-by-step: filing the execution petition
Treat the award as a money decree and follow Order 21.
Step 1 — Confirm executability
Check the award date, any correction under Section 33, and the Section 34 clock (three months plus a further thirty days if sufficient cause is shown). Note any pending challenge and any stay order.
Step 2 — Trace assets
List bank accounts, FDRs, receivables, vehicles and immovable property in Hyderabad, Medchal-Malkajgiri or elsewhere. Order 21 Rule 41 lets the court examine the debtor on assets if you cannot map them fully at filing.
Step 3 — Choose the court
File where the debtor or the attachable asset is. For a Medchal land parcel or a local business account, an arbitral award execution petition at Medchal is often the practical choice. For a Hyderabad current account or a commercial dispute of specified value, use the Commercial Court at Hyderabad / L.B. Nagar.
Step 4 — Draft the Order 21 Rule 11(2) petition
The application is written, signed and verified, in tabular form. It should state the parties, award date, amount with interest, payments already received, previous execution attempts, the person against whom execution is sought, and the mode of assistance (attachment of bank account, attachment and sale of property, garnishee, arrest only if the statutory conditions are met).
Step 5 — Annex documents and file
Pay court fee as applicable in Telangana (verify the current schedule). Serve notice. Seek interim attachment if there is a real risk of dissipation.
Step 6 — Press the mode that actually recovers money
Attachment of a bank account under Order 21 Rules 46 to 46H is usually faster than sale of land. A garnishee notice to the bank freezes the credit balance. Follow through to payment out. Immovable attachment needs correct survey numbers, boundaries and encumbrance data — sloppy description is a favourite defence.
Step 7 — Meet objections without retrying the arbitration
The executing court cannot sit in appeal over the award. Telangana High Court authority, including M/s MSR Enterprises and the 2025 Division Bench in Hyderabad Metropolitan Development Authority v. Cyberabad Expressway Ltd., is clear that Section 47 CPC is not a second Section 34 or a substitute for a Section 37 appeal.
Attachment of bank accounts under Order 21
For most commercial awards, the first useful step is attachment of a bank account under Order 21. That is how enforcing a domestic award in Hyderabad usually starts.
What typically works:
Identify the bank, branch, account number and IFSC if known.
Ask for a prohibitory / garnishee order so the bank does not pay the debtor.
If the number is unknown, seek a disclosure affidavit and banker’s disclosure under Rule 41, then attach.
Combine account attachment with a restraint on alienation of known immovable property so the debtor cannot shift value.
Limits to keep in view:
Section 60 CPC exemptions still matter (certain salary portions, tools of livelihood, and other listed items).
Joint accounts and accounts of non-parties need careful pleading. Attach only the debtor’s interest.
A cyber-police or tax freeze on the same account is a separate problem. Coordination, not assumption, is required.
Arrest in execution is a last resort. Jolly George Varghese still governs civil detention. Do not lead with arrest in a routine money award.
If the account is with a Hyderabad, Cyberabad or Medchal branch, say so in the petition. Territorial facts help the court issue the garnishee order to the right branch or nodal officer.
Limitation: do not sleep on the award
For a domestic award, the working rule is Article 136 of the Limitation Act, 1963: twelve years from the date the award becomes enforceable. “Enforceable” is not always the award date. It is usually when the Section 34 window closes, or when the Section 34 petition is dismissed and no stay survives. Compute the date with care.
Section 5 condonation is generally not available for Article 136 applications. Flag the computation for counsel review on your facts.
Foreign awards are treated differently. Do not apply the twelve-year rule to a New York Convention award without checking the current Section 47–49 and Article 137 debate.
Interest keeps running as the award directs. A delayed execution petition still claims interest, but assets disappear. File early.
Documents needed for the execution court
Certified copy of the arbitral award and any Section 33 correction.
Arbitration agreement or the clause from the contract.
Computation sheet: principal, pre-award interest, post-award interest, costs, amounts already paid.
Proof that Section 34 time has expired, or copies of the Section 34 docket with a statement that no stay operates.
Asset list: bank particulars, property schedule, company CIN and registered office if the debtor is a company.
Affidavit in support, identity and address proof of the award-holder.
Vakalatnama and court-fee receipt.
If you seek attachment of a specific account, the branch details and a draft garnishee order.
Stamp-duty / deficit-stamp position on the award — verify current Telangana practice before the court insists on impounding.
Missing computation and missing asset particulars are the two defects that delay numbering of the EP.
Common mistakes
Waiting for the Section 34 case to end before filing execution.
Filing only in the seat court when the money sits in a Medchal or Hyderabad account.
Treating Section 47 CPC as a merits appeal against the award.
Vague property description, or “all bank accounts of the judgment-debtor” without a disclosure application.
Ignoring a live stay and inviting costs.
Leading with arrest instead of attachment.
Mixing a foreign award with the Section 36 domestic route.
Assuming commercial-court jurisdiction without checking specified value and the latest territorial notification.
Letting the twelve-year clock run while settlement talks drift.
When the award-debtor should consult an advocate
If you are the person against whom the award runs, time is short. Check whether a stay application with a deposit proposal is still open. Check whether the execution court has territorial reach over your account. Do not raise stale Section 34 grounds in the EP. If the award is already stayed on conditions, missing the deposit date can revive attachment overnight.
If you are the award-holder and the debtor has started shifting funds, seek urgent attachment and a Rule 41 disclosure at the first listing.
Bullet-point checklist
Confirm the award is domestic and the Section 34 period has expired, or that no stay is in force.
Compute the executable sum with interest up to the proposed filing date.
Map assets in Hyderabad, Medchal-Malkajgiri and other districts.
Pick the court: Commercial Court (specified value ₹3 lakh+), City Civil Court, District Court Medchal, or High Court Commercial Division only if that forum actually fits.
Draft an Order 21 Rule 11(2) tabular execution petition.
Lead with attachment of bank account / garnishee where the money is.
Annex award, agreement, computation, no-stay affidavit and asset schedule.
Do not plead Section 47 as a second challenge to the award.
Diary the Article 136 twelve-year limit.
If you need a stay as debtor, move Section 36(3) with a deposit plan — Popular Caterers is against unconditional stay of money awards.
Conclusion
Enforcing a domestic award in Telangana is a decree-execution exercise under Section 36 and Order 21. The award-holder’s advantage after 2015 — and after Popular Caterers in 2025 — is that a pending challenge does not freeze recovery. The practical work is choosing the right Hyderabad or Medchal court, pleading a clean Rule 11(2) petition, and attaching the account or property that actually holds value.
The award-debtor’s work is to seek a conditioned stay early, not to relitigate the arbitration in the execution court. File with a complete computation and a real asset map. That is what moves money.

Questions
Can I file an arbitral award execution petition in Medchal if the arbitration sat in Hyderabad?
Yes, if the judgment-debtor or attachable assets (land, office, bank account) are within Medchal-Malkajgiri territorial limits. Sundaram Finance does not require a prior transfer from the seat court. Confirm the correct civil or commercial court for that asset.
Does a pending Section 34 petition stop attachment of my bank account?
No, unless the court has granted a stay under Section 36(3). After Popular Caterers, unconditional stay of a money award is exceptional. Expect a deposit condition.
Which court in Hyderabad executes a domestic commercial award?
Usually the Commercial Court at Hyderabad or at L.B. Nagar when specified value is ₹3 lakh or more (Janset Labs, Telangana High Court, 2025). Non-commercial or below-threshold matters go to the ordinary civil court with pecuniary jurisdiction. Verify the live map.
How do I attach a bank account in execution of an award?
File the EP under Section 36 read with Order 21. Seek a prohibitory / garnishee order against the bank under Rules 46–46H. If you do not have the account number, first seek disclosure under Rule 41.
What is the limitation for enforcing a domestic award?
Article 136 — twelve years from the date the award becomes enforceable. Calculate that date from the close of the Section 34 window or from dismissal of the challenge. Section 5 condonation is generally not available. Have the date checked.
Can the executing court reduce the awarded amount?
Not on merits. Execution is not a rehearing. Limited process objections (identity of parties, satisfaction, stay, property description) are different from attacking the award. Telangana High Court has rejected Section 47 as a backdoor challenge.
Is arrest possible for non-payment of an arbitral award?
Order 21 arrest provisions can apply because the award is enforced as a decree, but civil detention is tightly controlled. Courts look at means and Jolly George Varghese. Attachment of accounts and property is the primary tool.
What if the award-debtor’s only asset is outside Telangana?
You may file execution in the State where the asset lies. You do not need a transfer certificate from the Hyderabad seat court. Coordinate if parallel EPs are needed in two States.
