Forged Sale Deed Police Complaint in Medchal: BNS Case vs Civil Cancellation Suit

Forged Sale Deed Police Complaint in Medchal: BNS Case vs Civil Cancellation Suit
A practical guide for landowners, buyers, borrowers and litigants in Hyderabad, Medchal-Malkajgiri and Telangana
Introduction
A forged sale deed police complaint in Medchal is not the automatic first step every time someone else registers a document on your land. Some cases are true document forgery and support land grabbing criminal action in Hyderabad. Others are title fights that belong in a civil cancellation or declaration suit. Choosing the wrong forum wastes years, invites a quash petition, and can weaken your civil case.
This guide explains, in practical terms, when a Bharatiya Nyaya Sanhita (BNS) complaint is justified, when you should file a civil suit instead, what document forgery proof courts and police actually look for, and which Medchal-Malkajgiri and Hyderabad forums matter.
What a Forged or Fabricated Deed Really Means
A registered sale deed looks official. Registration does not prove that the seller had title, that the signature is genuine, or that the person who stood at the Sub-Registrar was the real owner.
In practice, fabricated-deed cases in Medchal, Keesara, Ghatkesar, Shamirpet, Kompally and the rest of the ORR belt fall into two buckets.
Bucket 1 — False document (criminal core)
Someone impersonated the owner, forged a signature, used a fake or dead person’s identity, created a bogus GPA, death certificate or legal-heir document, or altered a registered record. The paper itself is a lie.
Bucket 2 — Title dispute dressed as forgery (often civil)
The seller signed in his own name and claimed the land was his. You say he had no title. That may be a void or voidable transfer. It is not automatically “forgery” only because the seller was not the true owner.
The Supreme Court drew that line in Mohammed Ibrahim v. State of Bihar (2009) 8 SCC 751 and Sheila Sebastian v. R. Jawaharaj (2018) 7 SCC 581. Executing a sale deed in your own name, even dishonestly claiming ownership, is different from impersonating the owner or pretending to be authorised by the owner. The first path is usually a civil title fight. The second path can support a BNS complaint.
If you file an FIR only because “he sold my land,” police and the High Court may treat it as a civil dispute given a criminal colour.
BNS Sections Commonly Used in Forged-Deed Cases
For offences from 1 July 2024 onwards, cite BNS, not IPC. Older FIRs remain under the IPC sections that were in force on the date of the alleged act.
| BNS provision | Old IPC / practical use |
|---|---|
| Section 335 — making a false document | Old IPC 464. Core definition of a false document or electronic record. |
| Section 336 — forgery (including 336(3) for cheating) | Old IPC 463 / 465 / 468. Section 336(3) is commonly invoked for forged sale papers used to cheat. |
| Section 338 — valuable security, will, etc. | Old IPC 467. Use only if the document fits. Flag for verification on facts. |
| Section 340(2) — using a forged document as genuine | Old IPC 471. Typical charge against the person who produced the deed at the SRO or in court. |
| Section 318(4) — cheating and delivery of property | Old IPC 420. Needs deception plus dishonest inducement — not merely a rival deed. |
| Section 61 — criminal conspiracy | Old IPC 120-B. Used where vendor, GPA holder, scribe and occupier acted in concert. |
| Section 329 — criminal trespass | Old IPC 441 / 447. Add only if someone has entered or remains on the land with the required intent. |
Police in Cyberabad and Rachakonda often register a combination such as Sections 318(4), 336(3), 340(2) and 61 when the complaint alleges fake signatures, fake GPA or fake heir papers. Cyberabad EOW has used that pattern in recent plot-fraud files.
Cognizability and bail classification sit in the BNSS First Schedule. Simple forgery and some document offences are not treated the same as forgery-for-cheating. Get the schedule checked on the exact sections before you assume police must register an FIR on the spot.
| To be verified before filing Whether a particular sale deed is treated as a “valuable security” under Section 338 BNS varies with the instrument and the court. Do not inflate the complaint with Section 338 unless the facts fit. Also verify current cognizability of the exact combination you propose. |

When a BNS Complaint Is the Right Tool
File a police complaint when you can point to a false document, not only a bad title. Strong criminal facts usually look like this:
Your signature, or a family member’s signature, was forged on a sale deed, GPA, ratification or receipt.
A dead owner is shown as the living executant.
A fake Aadhaar, passport, death certificate or legal-heir certificate was used at the SRO.
A GPA was manufactured and then used to sell.
SRO or revenue records were tampered with — inserted document numbers, altered names, or cloned certified copies.
A gang used the same template across several vacant plots — a pattern seen in Keesara / Ghatkesar / Rampally arrests.
Occupants have been put on the land after the fake deed, with threats.
Land grabbing criminal action in Hyderabad is fact-specific. FIRs in Telangana still sometimes add Section 4 of the Andhra Pradesh Land Grabbing (Prohibition) Act, 1982. The old Special Court under that Act was abolished by G.O.Ms.No.420 dated 02.09.2016. Do not assume an LGC can still be filed in that Special Court. Verify the current forum before you draft any “land grabbing” petition. Regular civil courts and the criminal court remain the working forums for most private owners.
A criminal case can:
Trigger investigation, FSL comparison and SRO record seizure.
Support pressure against a professional forgery chain.
Sit alongside a civil injunction — it does not replace one.
A criminal case cannot, by itself, cancel the registered deed or restore title. That is civil work.
When a Civil Cancellation or Declaration Suit Is Safer — and Usually Essential
You need the civil court if you want the deed off the legal record, possession back, or an injunction against further sale.
Reliefs usually claimed in Medchal-Malkajgiri
Declaration that the impugned deed is void or not binding (Specific Relief Act, 1963, Section 34).
Cancellation under Section 31 — mainly if you are a party to the instrument or claim under a party.
Recovery of possession and mesne profits.
Permanent and temporary injunction under Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908.
Rectification of revenue / Dharani / Bhu Bharati entries after the decree.
Third parties are not always forced to sue for cancellation. The Supreme Court has held that a stranger to the deed may sue on title without a mandatory Section 31 prayer (Sk. Golam Lalchand v. Nandu Lal Shaw, 2024; Hussain Ahmed Choudhury line). Plead both title and cancellation if you were a party, or if the registered deed will keep circulating against you.
The Telangana High Court has also made a practical point that owners miss: the Joint Sub-Registrar is not the court that cancels a registered sale deed executed in favour of third parties. In W.A. No. 1356 of 2025 (order dated 06.01.2026), the Division Bench sent the party to the civil court. Do not wait for the SRO to “delete” the deed.
Unilateral cancellation by the original vendor at the SRO is a separate trap. Supreme Court law in Thota Ganga Laxmi (2010) 15 SCC 207 and Satya Pal Anand (2016) 10 SCC 767 does not treat a one-sided cancellation deed as a magic eraser. If that is your fact pattern, get the deed chain reviewed before you rely on an SRO cancellation.
Limitation — the point that sinks many suits
| Article / situation | Usual clock |
|---|---|
| Article 59 — cancel or set aside a voidable instrument | 3 years from when the facts first became known. Knowledge is not automatically the date of registration. |
| Article 58 — declaration | 3 years from when the right to sue first accrues. |
| Article 65 — possession based on title against a void forged deed | 12 years from when the defendant’s possession becomes adverse. Prem Singh v. Birbal (2006) 5 SCC 353; later SC restatement in 2025 on void deeds. |
| Composite suit where cancellation is the main relief | Rajpal Singh v. Saroj (2022) 15 SCC 260 treated the three-year clock as controlling. Draft the prayer carefully. |
Do not assume “forgery means no limitation.” Calculate both clocks and file the civil suit early. Pecuniary jurisdiction in Medchal-Malkajgiri (Junior Civil Judge, Senior Civil Judge, District Court at Kukatpally) follows the Telangana Civil Courts Act bands. Verify the current pecuniary limits before choosing the court.
Can You Run Both Cases Together?
Yes — but only if the criminal ingredients are independently made out. Civil and criminal proceedings can proceed together when the allegation is genuine forgery or cheating. A civil finding on title does not automatically kill a criminal trial, and an FIR does not decide title.
What courts dislike is an FIR used as leverage in a pure contract or family partition fight. Indian Oil Corpn. v. NEPC India (2006) 6 SCC 736 is still the warning: criminal law is not a recovery tool for civil claims. Telangana High Court regularly examines whether the complaint discloses impersonation or a false document, or only a disputed ownership story.
| Question | Civil cancellation / title suit |
|---|---|
| What it decides | Whether the deed binds you; title; possession; injunction; mutation after decree. |
| Who must be sued | Executant, beneficiary, subsequent purchasers, and necessary revenue / SRO parties as advised. |
| Typical court | JCJ Medchal / SCJ / District Court, Medchal-Malkajgiri at Kukatpally; City Civil Court Hyderabad if the land sits there. |
| Clock that kills the case | Often 3 years (Arts. 58 / 59) or 12 years (Art. 65) — plead the main relief correctly. |
| Can police replace it? | No. An FIR does not cancel a registered deed. |
| Question | BNS / police complaint |
|---|---|
| What it decides | Whether an offence is made out — not who owns the land. |
| Usual sections | BNS 318(4), 336(3), 338 / 340(2), 61; trespass 329 if facts fit. |
| Typical forum | Jurisdictional PS (Cyberabad / Rachakonda); EOW for organised plot fraud; Magistrate; TG HC s.528 BNSS. |
| Key ingredient | False document, impersonation, fake GPA / identity papers — not merely a rival deed. |
| Can it cancel the deed? | No. Only a competent civil court decree, then SRO / revenue follow-up, does that. |
Practical rule used in chambers:
Impersonation, fake signature, fake GPA, fake identity papers — FIR and civil suit.
Rival registered deeds, family partition, unpaid sale consideration, or “he sold what he did not own” in his own name — civil suit first; criminal only if extra facts appear.
Need an immediate stop on construction or further sale — civil interim injunction. Do not expect the police to decide title.
Document Forgery Proof: What Actually Moves the File
Police and civil judges do not act on a WhatsApp rumour. Build a paper trail before you walk into the station.
Identity and title set
Your mother deed, patta, Occupancy Rights Certificate (if Inam), and link documents.
Latest encumbrance certificate covering the survey number.
Certified copy of the impugned deed from the SRO.
Dharani / Bhu Bharati printout and passbook.
Family tree, legal-heir certificate, death certificate of the true owner.
Your identity proofs and photographs matching SRO records.
Forgery-specific set
Side-by-side signature comparison (old registered deeds versus the suspect deed).
Proof the alleged executant was abroad, hospitalised, or already dead on the date of execution.
SRO thumb-impression, photograph and Aadhaar used at registration.
GPA and the identity papers used to register the GPA.
Stamp-paper source (SHCIL / authorised vendor) if dummy stamp paper is suspected.
Witness affidavits of non-execution.
Bank trail showing you never received consideration.
Layout, GHMC / HMDA / municipality file if plots were carved.
Investigation set (criminal)
Written complaint with a chronology and document index.
List of accused with roles (vendor, GPA holder, scribe, witness, stamp vendor, occupier).
Application for FSL / handwriting opinion.
Request to seize SRO volume, thumb-impression register and CCTV, if still available.
Prior complaints, if any, to show a gang pattern.
Under the Bharatiya Sakshya Adhiniyam, 2023, electronic records still need a proper certificate. Do not dump phone screenshots into the court file without the supporting certificate and device particulars. Handwriting opinion helps. It is not a substitute for the rest of the chain. Courts look at who stood at the SRO, whose photo is on the deed, and whether the real owner could physically have executed it.
Step-by-Step: BNS Complaint in Medchal / Hyderabad
Map the police station to the land. Medchal-Malkajgiri properties fall under Cyberabad or Rachakonda stations (Medchal, Keesara, Shamirpet, Ghatkesar, Pet Basheerabad, Jeedimetla and others). File where the property lies or where the forged document was used. Zero-FIR is available if you are outside the local station, then transfer. Verify the current police-district chart.
Give a written complaint under Section 173 BNSS to the Station House Officer. Attach the certified copy, EC, your title set and a short chronology. Ask for a free FIR copy under Section 173(2).
If the offence is in the mid-range of punishment, Section 173(3) BNSS allows a preliminary inquiry up to 14 days with DSP permission for certain cognizable offences punishable with three years or more but less than seven years. Verify whether your proposed sections fall inside that window. Do not treat delay beyond that window as normal.
If the SHO refuses, write to the Superintendent of Police under Section 173(4) BNSS with the same annexures.
If the SP route fails, move the jurisdictional Magistrate under Section 175(3) BNSS. The application must be supported by an affidavit and must show that you already used Section 173(1) and 173(4). This is the statutory form of the Priyanka Srivastava (2015) 6 SCC 287 discipline.
Private complaint. You can also file a complaint before the Magistrate under Section 223 BNSS (old Section 200 CrPC). The accused now has a pre-cognizance hearing under the first proviso to Section 223(1). High Courts are still settling the exact stage of that hearing — flag for human review on current Telangana practice.
Accused side. Anticipatory bail is under Section 482 BNSS. Quashing is under Section 528 BNSS before the Telangana High Court. A civil suit pending in Medchal does not, by itself, get the FIR quashed if impersonation is alleged.
Do not send the complaint only on WhatsApp. Keep RPAD / acknowledgement copies.
Step-by-Step: Civil Cancellation / Declaration in Medchal-Malkajgiri
Collect certified copies and a 30-year encumbrance certificate.
Issue a legal notice if you need it for a limitation record or to fix knowledge. A notice does not stop limitation by itself.
File the suit in the correct civil court for the property and valuation.
File interlocutory applications on day one: temporary injunction, and if needed appointment of an advocate-commissioner.
Seek a direction to the SRO not to entertain further documents only as an aid to the injunction, not as a substitute for a decree.
After decree, apply for mutation / Dharani correction and for an updated EC. Communicate a cancellation decree to the Sub-Registrar under Section 31(2) of the Specific Relief Act where cancellation was granted.
If the opposite party may obtain an ex parte injunction against you, consider a caveat under Section 148A of the CPC in the expected court.
Commercial Court at Hyderabad applies only if the dispute is a “commercial dispute” of specified value. A family land-grab or forged-deed fight is usually an ordinary civil suit. Verify if your facts are commercial.
Forums at a Glance — Hyderabad / Medchal
| Need | Forum |
|---|---|
| FIR / investigation | Jurisdictional PS — Cyberabad or Rachakonda; EOW in organised plot fraud. |
| Magistrate complaint / s.175(3) | JMFC / Metropolitan Magistrate, Medchal-Malkajgiri (Kukatpally / local MM — verify roster). |
| Cancellation, declaration, possession, injunction | JCJ Medchal / SCJ / District Court, Medchal-Malkajgiri at Kukatpally; City Civil Court Hyderabad if the property sits in that jurisdiction. |
| Quash / exceptional writ | Telangana High Court at Hyderabad — Section 528 BNSS / Article 226. |
| Anticipatory bail | Sessions Court / High Court under Section 482 BNSS. |
| SRO records, 22-A list, EC | Concerned SRO (Medchal, Keesara, Shamirpet, Ghatkesar and others) and District Registrar. |
| Revenue entries | Tahsildar / RDO Keesara or Malkajgiri; Collector only for listed statutory remedies. |
Common Mistakes That Damage Both Cases
Treating every rival sale deed as “forgery” without a false-document fact.
Filing only an FIR and skipping the civil suit until the three-year Article 59 clock has run.
Asking the Tahsildar or SRO to cancel a registered third-party deed.
Naming the scribe, stamp vendor and every witness as accused without a role. That invites quash.
Relying on an unregistered family settlement against a registered fabricated deed without a proper title pleading.
Handing original title deeds to “mediators” or the opposite party.
Posting accusations on social media before the complaint is filed.
Ignoring Section 22-A prohibited-list issues that block a later regularisation sale.
Assuming the 1982 Land Grabbing Special Court is still sitting.
Using force to retake possession. Self-help creates a criminal case against you.
When to Consult an Advocate
See a local advocate before the FIR if:
There are two registered deeds on the same survey number.
A GPA chain or NRI owner is involved.
The land is Inam, assigned, 22-A listed, or in an FTL / buffer zone.
You need an injunction this week.
You are the person named in the deed and fear arrest.
A short opinion on Mohammed Ibrahim versus true impersonation will often decide whether the criminal case survives.
Bullet-Point Checklist
Certified copy of the suspect deed and a full encumbrance certificate.
Your link documents and Dharani / passbook print.
Proof the real owner did not execute (death, travel, hospital, old signatures).
GPA and identity papers used at the SRO.
Written Section 173 BNSS complaint with chronology and annexure index.
SP representation under Section 173(4) if the SHO sits on the file.
Civil suit draft with declaration / cancellation / possession / injunction.
Limitation note: Article 59 (3 years) versus Article 65 (12 years).
FSL / handwriting request and BSA certificate for electronic records.
Caveat in the civil court if the other side may move first.
No reliance on SRO “unilateral cancellation” as a final remedy.
Conclusion
A fabricated deed on Medchal or Hyderabad land is both a paper problem and a possession problem. Criminal law punishes the false document. Civil law takes the deed off the title and gives the land back. Use a BNS complaint when there is impersonation, a forged signature, a fake GPA or fake identity papers. Use a cancellation or declaration suit when you need the register corrected. In most real files you will need both, in the right order, with limitation calculated on day one.
Start with the certified copy, the encumbrance certificate, proof of non-execution and the date you first learnt of the deed. File the civil suit that can actually deliver the land. Use the criminal process only on facts that survive Mohammed Ibrahim and Sheila Sebastian.

Questions
Can I file a forged sale deed police complaint in Medchal without a civil suit?
Yes, if the facts show a false document. Title and possession still need a civil decree. File both when the deed is already on the encumbrance certificate.
Will police register an FIR for every land dispute?
No. If the seller signed in his own name and only title is disputed, many files are closed as civil. Impersonation, fake signature and fake GPA are the facts that usually open a crime.
What is the best document forgery proof?
A certified copy plus proof the named executant could not have signed — death, foreign travel, admitted signatures on earlier registered deeds, SRO photograph mismatch, and a coherent consideration trail. Expert opinion supports that chain; it does not replace it.
How long do I have to cancel a fabricated deed?
If you must set aside a voidable deed, plan for three years from knowledge (Article 59). If the deed is void and you sue on title for possession, twelve years under Article 65 may apply. Get the plea framed correctly. Composite “cancel and possess” suits have been held to the shorter clock when cancellation is the main relief.
Can the Sub-Registrar cancel the forged deed if I complain?
Not as a substitute for a court decree where third-party rights were created. Telangana High Court has sent such parties to the civil court. Use the SRO for certified copies, refusal of further documents when a court so directs, and 22-A / prohibited-list issues.
Is land grabbing a separate criminal case in Hyderabad?
Police sometimes add Section 4 of the 1982 Act. The Special Court under that Act was abolished in 2016. Verify current maintainability before you draft an LGC-style case. Ordinary civil and BNS remedies remain the working path for most private owners.
Can the accused get the FIR quashed because a civil suit is pending?
Pending civil litigation is a relevant fact, not an automatic bar. Quash under Section 528 BNSS succeeds more often when the complaint discloses only a title dispute and no false-document ingredient.
What if police refuse the FIR in Medchal?
Escalate to the Superintendent of Police under Section 173(4) BNSS, then to the Magistrate under Section 175(3) with a sworn affidavit. A private complaint under Section 223 BNSS is the other track.
