Filing a Writ Against Arbitrary GST Demands

Introduction
Filing a writ against arbitrary GST demands before the Telangana High Court is possible — but it is not the first or automatic remedy. For most Hyderabad and Telangana businesses, the statute first requires an appeal under Section 107 of the CGST / TGST Act and, after that, a second appeal before the GST Appellate Tribunal (GSTAT).
A writ under Article 226 is reserved for cases where the demand is without jurisdiction, natural justice has been denied, the order is unsigned or legally non-est, recovery is being pushed in a manner the law does not allow, or a provision itself is under challenge. If the dispute is only about invoices, ITC matching, turnover computation or reconciliation, the High Court will usually send the taxpayer back to the appellate authority.
This guide explains, in practical terms, when a GST writ in Hyderabad is maintainable, what to file, which documents matter, how limitation and pre-deposit work, and the mistakes that get petitions dismissed.
What counts as an “arbitrary” GST demand?
Not every high demand is arbitrary. In GST practice, a demand looks arbitrary when the officer has not applied the process the Act requires. Typical red flags for Telangana taxpayers are:
- A show cause notice (SCN) in Form DRC-01 that does not spell out the charge, the period, or the evidence.
- An order in Form DRC-07 passed without considering the reply, or without a personal hearing where Section 75(4) required one.
- Use of the harsher Section 74 (fraud / suppression) route when the notice only alleges a mismatch or a difference of opinion.
- An order or notice with no digital or physical signature, or without a Document Identification Number (DIN) where circulars require one.
- A demand that travels beyond the SCN.
- Recovery through DRC-13 / bank attachment while the statutory appeal window is still open, or without the higher-authority approval that CBIC guidelines expect for early recovery.
A large ITC disallowance, by itself, is usually a merits dispute. That belongs in a Section 107 appeal, not in a writ.
The correct forum map for Hyderabad / Telangana
Work through the ladder in this order. Skipping a step is the most common reason a writ fails.
- Reply and personal hearing before the Proper Officer (Section 73, 74 or, for later years, 74A — verify the year-wise provision that applies to your notice).
- First appeal under Section 107 to the Appellate Authority, in Form GST APL-01, generally within three months of communication of the order, with a further one month that can be condoned for sufficient cause. Beyond that four-month outer limit, the Appellate Authority ordinarily cannot admit the appeal.
- Second appeal under Section 112 to GSTAT. The Tribunal is now functional (portal notified in September 2025; adjudicatory sittings from February 2026). High Courts across India are sending taxpayers to GSTAT instead of keeping writs alive only because the Tribunal was earlier missing.
- Statutory appeal to the High Court under Section 117 against a GSTAT State Bench order, on a substantial question of law, not on facts.
- Writ petition under Article 226 to the Telangana High Court at Hyderabad — only in the exceptional buckets set out below.
- Supreme Court thereafter, if the High Court order itself is challenged.
GST tax writs in Telangana are ordinarily heard by a Division Bench. Name the correct respondents: the Proper Officer who passed the order, the Commissioner / Principal Commissioner, the Union of India / State of Telangana as needed, and the bank if attachment is under challenge.
Related but different: a challenge to provisional attachment of a bank account under Section 83 follows its own path (objection in Form DRC-22A and, often, a writ because Section 83 orders are not appealable under Section 107). Do not mix a Section 83 attachment case with a routine DRC-07 merits challenge.
When the Telangana High Court will entertain a GST writ
The Supreme Court has repeatedly said that an alternative remedy does not abolish writ power, but the High Court will use that power only in limited situations. The working tests come from Whirlpool Corporation, restated in Radha Krishan Industries v. State of Himachal Pradesh (2021) 6 SCC 771 and Magadh Sugar & Energy Ltd. v. State of Bihar.
A GST writ in Hyderabad is usually arguable when you can show one or more of the following.
1. Violation of natural justice
Examples that Telangana and other High Courts have treated seriously:
- No personal hearing though an adverse order was contemplated (Section 75(4)).
- Reply uploaded on the portal but not dealt with in the order. The Court may still send you to Section 107, as in Intech Analytical Instruments (Telangana High Court, April 2026), while protecting limitation.
- Appellate order dismissed without hearing — Rythu Seva Kendram Bairanpally (Telangana High Court, March 2026) remanded the appeal.
- Hearing held by one officer and order signed by a successor who never heard the taxpayer. Other High Courts have set such orders aside; plead the same principle if the facts match.
- Hearing fixed before the reply due date, so the hearing is an empty formality.
2. Order wholly without jurisdiction
Examples: notice by an officer who is not the Proper Officer; demand for a period already covered by a final order; proceedings continued in the teeth of a binding High Court remand. The Telangana High Court has set aside a fresh SCN issued after the Court had directed adjudication of the original notice.
3. Legally non-est notice or order
Telangana High Court has, in several 2025 batch matters including Water Tech Engineers v. Assistant Commissioner of CGST (2025), treated a DRC-07 without the required digital signature as invalid because the Act and Rules prescribe the manner of authentication. Unsigned or DIN-less communications remain a live ground — but later benches have sometimes given liberty to file a delayed Section 107 appeal instead of quashing on the first date. Plead the defect clearly and keep screenshots of the portal PDF.
4. Challenge to the vires of a provision
Constitutional challenges (for example, to Section 16(2)(c) / 16(2)(aa) ITC conditions) are still filed in writ. Even then, the Court may keep the legal question open and send the quantum dispute to the Appellate Authority, as it did in the Rythu Seva Kendram matter.
5. Fundamental-rights / recovery overreach
Coercive recovery while the appeal limitation is still running, attachment of a third-party account, or recovery that ignores CBIC’s own early-recovery protocol, can justify an urgent writ limited to stay of recovery, even if the Court later relegates the merits.
When a writ will almost certainly fail
Do not file a writ as a substitute for pre-deposit. Courts now treat GSTAT as an effective forum. Expect dismissal or relegation if:
- The only grievance is computation of ITC, RCM, turnover or reconciliation. Delhi High Court said so in September 2026; Telangana practice is aligned.
- You slept over the three-month / four-month Section 107 window and now want the High Court to sit as an Appellate Authority. The Supreme Court has affirmed the Telangana High Court’s refusal to entertain a delayed GST writ on this footing (Prashanth Kumar Poddaturi).
- You challenge a SCN that is not without jurisdiction. A defective but understandable SCN, followed by a full reply, may survive (Trillion Lead Factory, Telangana High Court, February 2026, later before the Supreme Court).
- You want the Court to re-appreciate invoices and ledgers.
Even when the Court does not decide merits, it often grants a short protective window (commonly 7–15 days) to file the statutory appeal and stay application, and directs that no coercive action be taken till the Appellate Authority looks at the stay. That is useful — but it is not a win on the demand.
Step-by-step: how a GST writ is filed in Telangana High Court
Step 1 — Audit the record before you draft
List every form: DRC-01A (if any), DRC-01, replies, personal-hearing notices, adjournment letters, DRC-07, APL-01 / APL-04, DRC-13, DRC-22. Download the exact PDF from the GST portal, including the “Additional Notices” tab. Many Hyderabad assessees miss an order sitting only on that tab.
Check: DIN, digital signature, date of communication (not merely the date printed on the order), whether Section 73 or 74 was invoked, and whether the order travels beyond the SCN.
Step 2 — Decide writ versus appeal in writing
If the case is 80% facts and 20% procedure, file Section 107 first and use the writ only against illegal recovery. If the order is unsigned, without hearing, or without jurisdiction, a writ plus an interim stay application is the usual combination.
Step 3 — Pre-deposit and recovery strategy
A Section 107 appeal is admitted only after the mandatory pre-deposit under Section 107(6) — generally 10% of the disputed tax (not the entire interest and penalty stack), subject to the statutory cap. Finance Act changes and the 1 October 2025 amendment for penalty-only appeals are fact-sensitive. Delhi High Court has held the new penalty pre-deposit does not govern SCNs issued before that date, and the Supreme Court has issued interim directions in a similar setting. Verify the rate and cap that apply to your notice date before paying.
Blocked ITC under Rule 86A is not automatically treated as pre-deposit.
Filing a proper appeal with pre-deposit stays recovery of the balance under Section 107(7). That is often cheaper and faster than a writ stay.
Step 4 — Draft the writ petition
GST writs in Telangana typically seek a writ of mandamus / certiorari to quash the SCN and / or DRC-07 and consequential recovery, with an interim prayer to stay coercive steps including bank attachment.
Keep the affidavit chronological. Plead:
- dates of notice, reply, hearing and order;
- the exact natural-justice or jurisdiction defect;
- why Section 107 / GSTAT is not efficacious on these facts (pre-deposit making the remedy illusory is argued often, and rejected often — use it only with numbers);
- delay, if any, with a candid explanation;
- the precise interim protection needed.
Do not copy-paste “no alternative remedy” if an appeal still lies.
Step 5 — File and mention for stay
File through the Telangana High Court e-filing system, pay court fee, and mention for urgent listing if attachment or auction is in motion. Carry certified / portal copies of the impugned order and SCN, proof of service / portal upload, the bank attachment notice if any, a calculation of disputed tax versus admitted tax, and a short note on alternative remedy.
Step 6 — What usually happens on the first date
Three common outcomes:
- Notice plus interim stay of recovery.
- Petition disposed of with liberty to file Section 107 / GSTAT appeal within a fixed number of days, and a direction of no coercive action till the stay application is heard.
- Dismissal on alternative remedy or delay, with or without liberty.
Plan for outcome 2. Keep the appeal papers and pre-deposit ready on the day of the writ listing.
Documents needed for a Telangana GST writ
- GST registration certificate and PAN.
- Full SCN (DRC-01) and any DRC-01A intimation.
- Every reply and annexure filed on the portal, with ARN / acknowledgement.
- Personal-hearing notices, attendance proof, written submissions handed over at hearing.
- Impugned order and DRC-07 PDF as downloaded (show signature / DIN page).
- Screenshot of the GST portal “Notices and Orders” and “Additional Notices” tabs with date-time.
- Annual returns, GSTR-1 / 3B, invoices, e-way bills and reconciliations relied on.
- If Section 74 is used: the material that is said to show fraud or suppression.
- Recovery papers: DRC-09, DRC-13, bank letter, Form DRC-22 / DRC-22A.
- Earlier High Court / appellate orders if the matter is on remand.
- Vakalatnama, board resolution / authorisation for a company, Aadhaar of the deponent.
- Delay affidavit if the writ is not immediate.
Timelines that actually matter
| Stage | Working timeline | Practical note |
|---|---|---|
| Reply to SCN | As stated in the notice | Ask for hearing in writing even if the portal tick-box says “No”. |
| Order under Section 73 | Generally within 3 years from the relevant date (linked to GSTR-9 due date) | SCN must precede the order by about 3 months. Year-wise dates need verification. |
| Order under Section 74 | Generally within 5 years | Needs fraud / suppression; SCN about 6 months before the order. |
| Section 107 appeal | 3 months from communication + 1 month condonation | Communication date, not the date typed on the PDF, usually starts limitation. |
| Recovery (ss. 78 / 79) | Ordinarily after 3 months of the order | Earlier recovery needs recorded reasons and higher-authority approval (CBIC instruction of 30 May 2024). |
| GSTAT (Section 112) | 3 months from communication of the appellate / revisional order, plus limited condonation | Backlog windows notified in 2025–26 were time-bound. Confirm the window that still applies to your order. |
| Writ (Art. 226) | No fixed statute of limitation | Unexplained delay is fatal. File as soon as the defect is known. |
Section 74A (unified limitation for later financial years) should be checked if the notice relates to FY 2024-25 onwards. Treat year-wise last dates as points to be verified against the notification that applied to that year.
Hyderabad-specific practice points
- Watch the Additional Notices tab. Several Telangana writs turn on late discovery of a portal-only order.
- CGST and TGST officers in Hyderabad, Secunderabad, Jeedimetla, Rangareddy, Cyberabad and Shamshabad divisions are frequent respondents. Identify the Commissionerate from the DIN / order header.
- If a composite DRC-07 ropes in an unregistered director with the company, the High Court has directed separate DRC-07s and a temporary registration so that the director can appeal (Bharat Kumar Agarwal, April 2026).
- A writ is a poor tool to cure a missed appeal. If you are only a few weeks beyond three months, a Section 107 appeal with a condonation application is usually the cleaner route. If you are beyond four months, take specific advice before choosing between a writ and any other path.
Bullet-point checklist before filing
- Confirm the order was communicated and note that date.
- Download the signed PDF; check DIN and digital signature.
- Confirm whether a Section 107 appeal still lies and whether pre-deposit is affordable.
- Isolate the writ ground: hearing, jurisdiction, unsigned order, ultra vires, or illegal recovery — not mere quantum.
- Collect portal screenshots of the Additional Notices tab.
- Prepare the appeal and pre-deposit in parallel so you can use a “liberty to appeal” order the same week.
- Do not wait for the bank freeze to become a fait accompli; DRC-13 needs same-week action.
- Do not plead “no alternative remedy” if GSTAT is open on your facts.
- Do not treat Rule 86A blocked credit as pre-deposit.
- If the only issue is invoices and GSTR mismatch, file the appeal, not the writ.
Conclusion
A writ against an arbitrary GST demand in the Telangana High Court is a surgical remedy, not a parallel appeal. Use it when the officer has skipped the hearing the law requires, acted without authority, issued an unauthenticated order, or started recovery the statute does not permit. For everything else — ITC mismatch, valuation, classification, reconciliation — file the Section 107 appeal on time, pay the correct pre-deposit, and keep GSTAT in view.
The taxpayers who do well in Hyderabad are the ones who download the portal record early, diary the communication date, and decide writ versus appeal with the stay papers already in the bag.

Questions
Can I file a writ in Telangana High Court directly against a GST DRC-07?
Only if you have a recognised exception: no hearing, no jurisdiction, a legally invalid order, a challenge to the provision itself, or illegal recovery. A routine tax computation case should go in a Section 107 appeal.
Is GSTAT now a bar to GST writs in Hyderabad?
It is a strong practical bar for second-appeal issues. Once GSTAT became functional, High Courts have declined writs that were filed only because the Tribunal did not exist. A first-appeal defect can still support a limited writ.
What if the department ignored my reply?
Plead it. Telangana High Court has often granted liberty to file the statutory appeal rather than quashing on that ground alone. File the writ quickly if recovery has started, and keep the appeal ready.
Does an unsigned DRC-07 make a writ automatic?
It is a strong ground in Telangana, especially after Water Tech Engineers. Outcomes still vary: some benches quash, some send the taxpayer to appeal with condonation. Annex the unsigned PDF.
Will the High Court stay GST recovery?
Often only for a short period, or only till the Appellate Authority hears the stay application. A filed Section 107 appeal with pre-deposit gives a statutory stay of the balance under Section 107(7). That is usually more reliable than an open-ended writ stay.
How much pre-deposit do I need?
For a regular tax demand, plan for 10% of the disputed tax at the first appeal, subject to the cap then in force. GSTAT requires a further deposit under Section 112(8). Penalty-only rules after 1 October 2025 are being litigated. Get the figure checked against your SCN date.
What is the limitation for a GST writ?
There is no GST section that fixes a writ deadline. Delay plus an available appeal is enough for dismissal. Treat weeks, not months, as the safe window after you know of the order.
Can I challenge a GST show cause notice before the order is passed?
Rarely. Courts interfere with SCNs only when the notice is without jurisdiction or the provision is under challenge. A vague notice is usually cured by a detailed reply and a demand for hearing.
