How to Apply for Bail in a Criminal Case in Hyderabad

The short answer
To apply for bail in a criminal case in Hyderabad, first decide which kind of bail you need.
- Regular bail — you are already arrested or in custody.
- Anticipatory bail — you apprehend arrest in a non-bailable case and seek an order that you shall be released on bail if arrested.
They are different applications. A magistrate, a Sessions Court, and the High Court of Telangana are different courts. Copying a format from the internet and changing the name is how defects are born.
This is general information. It is not a warranty of bail.
Anticipatory bail (BNSS Section 482)
Under the BNSS, from 1 July 2024, anticipatory bail is Section 482. It occupies the field that Section 438 of the CrPC occupied.
The Constitution Bench in Gurbaksh Singh Sibbia v. State of Punjab (1980) 2 SCC 565 refused to freeze the power into a rigid checklist, and equally refused to treat it as a right for the asking. Sushila Aggarwal v. State (NCT of Delhi) (2020) 5 SCC 1 held that anticipatory bail need not be time-bound as a matter of law, and can continue after the charge-sheet, subject to the court’s conditions and the power to cancel.
Courts in Telangana still look, in substance, at:
- the nature and gravity of the accusation;
- your role, as opposed to the omnibus naming of a family or a company;
- the likelihood of flight, tampering with evidence, or influencing witnesses;
- the need for custodial interrogation;
- antecedents, if any.
An application that merely recites those words, without the FIR, is not a case.
Regular bail
Once arrested, the application is to the court that has seisin of the case. Under the BNSS the corresponding provisions include Section 480 (the field of Section 437 CrPC) and Section 483 (the field of Section 439 CrPC) for the Sessions Court and the High Court. The charge-sheet, the period already spent in custody, and the risk of absconding are typical concerns. They are not a tariff.
Papers that actually help
- the FIR, complaint, or notice;
- a candid note of other cases (surprise criminal history does more damage than the allegation sometimes does);
- proof of residence and identity;
- documents that explain a commercial or matrimonial origin if that is the truth;
- medical papers only if they are true and relevant.
False documents are a separate problem.
Arrest is not the only question
Arnesh Kumar v. State of Bihar (2014) 8 SCC 273 still matters: the police must record reasons and consider whether arrest is necessary. A notice for appearance is not the same as an imminent arrest. See FIR registered against you in Hyderabad.

Nothing in this article is a warranty of bail or a direction to disobey a lawful order.

Questions
What is the difference between regular bail and anticipatory bail?
Regular bail is for a person already arrested or in custody. Anticipatory bail is a direction that the person shall be released on bail in the event of arrest in a non-bailable case. They are filed at different stages and often in different courts.
Which section is anticipatory bail after 1 July 2024?
For procedure governed by the BNSS, anticipatory bail is Section 482. For many older matters, Section 438 CrPC continues. The FIR and the date of the alleged offence decide. Do not copy an old format blindly.
Is anticipatory bail automatic in a non-bailable offence?
No. It is discretionary. The court looks at gravity, role, flight, tampering with evidence, and the need for custodial interrogation. Gurbaksh Singh Sibbia v. State of Punjab (1980) 2 SCC 565 remains the starting point.
Which court in Hyderabad should I approach?
It depends on the offence, the stage, and the code. Magistrates, the Sessions Court, and the High Court of Telangana are not interchangeable captions. The FIR, the remand, and the seisin of the case decide.
