Commercial and contract disputes in Medchal — SN Law Chambers

Commercial work at SN Law Chambers includes reading a contract before it is signed, recovering money after it is broken, and placing company or partnership disputes in the correct forum. Not every unpaid invoice is a criminal case. Not every shareholder argument belongs in the NCLT. The Specified Value, the arbitration clause and the nature of the claim decide whether the matter goes to a commercial court, a civil court, arbitration, or a company forum. Cheque-bounce and IBC have their own pages.

Legal issues we handle

When you may need legal assistance

How we approach the matter

Locate the signed contract, purchase orders, invoices and the arbitration or jurisdiction clause. Do not issue a criminal complaint as a substitute for a civil recovery without reading the ingredients of the offence. Preserve e-mail and WhatsApp in export form; do not edit the thread. Adv. Sainath Panjagari’s PGDTL and commerce qualifications are relevant to reading accounts and tax papers that sit behind many commercial briefs; they are not a claim to every tax listing in Telangana.

What to expect

If the Specified Value and the nature of the dispute put the case in a commercial court, pre-institution mediation under Section 12A may have to be exhausted. If the contract sends the parties to arbitration, a civil suit may be premature. If the default is a cheque, Section 138 is a different complaint. If the debtor is a company in genuine default without a pre-existing dispute, the IBC may be the instrument. The first advice is the forum. The second is the pleading.

Why the Medchal chambers can matter

Medchal does not have a separate commercial court of its own as a slogan. Commercial jurisdiction in Telangana follows the Specified Value and the courts notified for that purpose, often at Hyderabad. The contract, the value and the cause of action decide the listing. The chambers at Medchal Check Post is where instructions are taken from businesses in the industrial belt; the case still goes where the statute sends it.

Frequently asked questions

Should I file a police complaint for an unpaid commercial invoice?

Only if the facts disclose a cognizable offence. A genuine commercial default is often a civil or IBC question, not automatically cheating.

Does Medchal have a commercial court?

Commercial jurisdiction follows the Specified Value and the courts notified for that purpose, often at Hyderabad. The chambers’ location does not create a local commercial list.

Will you draft or review a contract before I sign?

Subject to conflict and the nature of the document, the chambers may review or draft after the papers are seen. An enquiry is not a retainer.

What is Section 12A?

For specified commercial suits, the Commercial Courts Act requires pre-institution mediation unless urgent interim relief is sought. Skipping it can be fatal to the plaint.

Is an arbitration clause always binding?

Usually it must be invoked or respected. Whether a stay under Section 8 of the Arbitration and Conciliation Act, 1996 is available depends on the clause and the stage. That is a file question.

When is NCLT the better forum than a commercial suit?

When the grievance is oppression, mismanagement, or a Code default that meets the IBC tests — not merely because a shareholder is angry.

Consultation

Bring the signed contract and the last invoice. If a notice or a Section 12A clock is running, say so. Consultations by appointment, Monday to Saturday. An enquiry is not a retainer.
