NCLT and insolvency work from Hyderabad and Medchal

NCLT and insolvency work from Hyderabad and Medchal — SN Law Chambers

The National Company Law Tribunal, Hyderabad Bench, hears insolvency and many company-law matters for Telangana. The Insolvency and Bankruptcy Code, 2016 is a collective, time-bound process. It is not an ordinary money-recovery suit. A genuine pre-existing dispute can defeat a Section 9 operational-creditor application. The chambers at Medchal advises creditors, companies and directors on whether the Code is the correct instrument, and on the documents the Adjudicating Authority actually requires. Bank SARFAESI recovery remains a DRT question unless the Code truly applies.

Types of matters handled

How we approach the matter

Check the default threshold and the date of default from the contract and bank records. For Section 9, examine whether a genuine dispute existed before the demand notice — the Supreme Court’s discussion in Mobilox Innovations (P) Ltd. v. Kirusa Software (P) Ltd. (2018) 1 SCC 353 remains the working test on ‘pre-existing dispute’. Do not use the Code as a pressure tactic on a seriously disputed invoice. The chambers will say if a civil suit or a commercial-court claim is the honest path.

What to expect

Demand-notice and filing windows are statutory and short. Count from the papers. Admission is not a decree for the operational creditor; it opens a collective proceeding. Directors and related parties have duties once a moratorium begins. This page does not explain every CIRP form. It explains when to instruct, and when not to file.

Why the Medchal chambers can matter

The Hyderabad Bench of the NCLT sits in Hyderabad. The chambers is in Medchal. Filing, listing and appearance follow the Tribunal’s roster, not the chambers’ address. Instructions can be taken at Medchal Check Post; the case is still an NCLT case. That is the geographical fact. It is not a claim that every Telangana insolvency is filed from this office.

Frequently asked questions

Can I file insolvency for an unpaid invoice?

Not merely because an invoice is unpaid. The Code has a default threshold and other conditions. A genuine pre-existing dispute may prevent a Section 9 admission.

Is the NCLT in Medchal?

No. The Hyderabad Bench sits in Hyderabad. The chambers is in Medchal. Appearance follows the Tribunal’s roster.

How short are the IBC clocks?

Demand-notice and filing windows are statutory and short. Count from the papers. Do not wait for a convenient date.

Is IBC a substitute for a civil recovery?

The Supreme Court has said the Code is not a substitute for a civil suit in a genuinely disputed debt. That is the working distinction in this chambers.

Can directors be made parties?

Personal liability and related-party questions are statute- and fact-specific. They are not assumed from a website heading.

Does SARFAESI stop if I file Section 9?

Not as a slogan. Moratorium, secured-creditor rights and the stage of each proceeding have to be read together.
