Divorce and family-court work in Medchal and Hyderabad

Family briefs at SN Law Chambers include Hindu marriage petitions, Special Marriage Act matters, maintenance, custody and proceedings under the Protection of Women from Domestic Violence Act, 2005. The child’s welfare is the primary consideration in custody. Quantum of maintenance turns on income proof, not on a percentage advertised on the internet. This page is the family-court note. A 498A or other criminal complaint that travels with the marriage is described on the criminal page; the two files must be managed together, not mixed into one heading.
Types of matters handled
Illustrative types of work taken on from the Medchal chambers. Clients are not named. A past matter is not a ranking, not a testimonial, and not a prediction of any other result.

- A husband or wife who needs financial disclosure read before filing or defending
- Someone who has been asked to sign a settlement without seeing the tax returns
How we approach the matter
The first task is to identify the personal law, the date of marriage, the last shared household, and which Family Court actually has jurisdiction. Filing in a convenient city court because it is closer to counsel is not a strategy. The chambers will ask for income papers on both sides as far as they are known. It does not promise reconciliations, and it does not treat every dispute as a case that must be filed. Adv. Sainath Panjagari holds an LL.M in Crimes & Torts; family files in this chambers are still read as civil and personal-law work first.
What to expect
A mutual-consent petition under Section 13B of the Hindu Marriage Act generally requires a year of separate living and a real agreement. The six-month wait under Section 13B(2) may be waived in an appropriate case; it is not automatic. A contested petition proceeds on pleadings, evidence and the grounds actually pleaded. Maintenance and custody applications can run in parallel. Interim orders are discretionary. Do not remove a child from the jurisdiction or dissipate joint assets without advice. Nothing on this page is personal advice on a pending marriage.
Forums that commonly arise
- Family Court having territorial jurisdiction — Hyderabad, Secunderabad or Medchal–Malkajgiri, as residence and the last shared household require
- Magistrate courts for domestic-violence applications and certain maintenance proceedings
- High Court for the State of Telangana for appeals and revisions that are maintainable
Papers to bring
- Marriage certificate; photographs of the ceremony if registration is disputed
- Birth certificates of children, school and medical records
- Income-tax returns, salary slips, business accounts and bank statements
- Prior orders, police complaints, DV applications and any settlement drafts
Why the Medchal chambers can matter
Family Court jurisdiction follows residence and the last shared household, not the chambers’ office. A couple living at Medchal Check Post does not automatically file in a Hyderabad city Family Court. Local representation matters for listing, for serving papers in Medchal–Malkajgiri, and for reading the actual cause-list. Appearances in Hyderabad and Secunderabad Family Courts are taken as the brief requires.
Frequently asked questions
Can we file mutual-consent divorce immediately?
For a Hindu marriage under Section 13B, the parties generally must have lived separately for at least one year and must actually agree. The six-month wait under Section 13B(2) may be waived in an appropriate case. It is not automatic.
Which Family Court — Hyderabad or Medchal?
Residence, the last shared household, where the marriage was solemnised and the relief sought decide the court. Medchal–Malkajgiri matters do not automatically go to a Hyderabad city Family Court.
Can a working spouse claim maintenance?
Employment does not automatically bar or guarantee maintenance. The court looks at actual income, needs, standard of living and the child’s expenses.
Is a 498A case the same as a divorce case?
No. One is criminal; one is matrimonial. They often travel together. Strategy on one file can damage the other if they are not read as a set.
Who decides custody?
The child’s welfare is the primary consideration. There is no automatic rule that a child of a given age ‘goes’ to one parent. Schooling, care, and the existing arrangement all matter.
Will the chambers draft a settlement I can sign today?
A settlement that is not read against the income papers, the child’s needs and the pending cases is a risk. Drafting follows instructions and the file, not a website template.
