Interim Orders vs Ex-Parte Stay vs Ad-Interim Relief — Practical Differences

Interim Orders vs Ex-Parte Stay vs Ad-Interim Relief — Practical Differences
A client-facing guide for litigants, borrowers, business owners and Hyderabad clients who need to know what the first court order actually does — and what it does not.
Introduction
Clients use “interim order”, “ex parte stay” and “ad interim relief” as if they were three names for the same piece of paper. They are not. An interim order vs ex parte stay vs ad interim relief turns on who was heard, how long the order is meant to last, and which statute the court is using. Mixing the labels in a prayer or in a client brief is how applications get refused, stays lapse, and the other side moves assets while you wait for the next date.
This article explains the practical difference in Indian civil and writ practice, with Hyderabad and Telangana forums where the procedure is local. It covers when each order applies, the three-fold test, Order 39 Rules 3, 3A and 4 of the Code of Civil Procedure, 1908, stay of a decree under Order 41 Rule 5, documents that actually move a judge, and the mistakes that lose the first hearing.
Nothing here is a promise that a board will grant relief. Courts treat these powers as exceptional. Delay, suppression of facts, a vague prayer, or the wrong forum will sink the application even when the underlying dispute is real.
Why the three labels confuse clients
Court staff, cause lists and WhatsApp updates often say “ad interim granted”, “ex parte stay till next date”, or “interim order made absolute”. Those phrases describe stages of the same fight, not three different statutes.
- “Interim” tells you the order is temporary and sits inside a pending case. It is not the final decree.
- “Ad interim” tells you the order is a holding order — usually till the next date or till the interlocutory application is heard.
- “Ex parte” tells you the opposite party was not heard before the order was signed.
You can have an interim order after both sides were heard. You can have an ad interim order that is also ex parte. You can have an ex parte stay of a tax demand or of execution that is not an Order 39 injunction at all. The first drafting job is to name the exact power you are invoking.
What each term actually means
Interim order
An interim order is any interlocutory direction given while the main case is still alive. It can be an injunction, a status quo direction, a stay of an administrative or tax order, appointment of a receiver, attachment before judgment, a direction to maintain accounts, or a stay of execution of a decree. After notice and a contested hearing, many courts confirm the first holding order “as an interim order pending disposal of the suit / petition / appeal”.
The legal test depends on the provision. For a temporary injunction under Order 39 Rules 1 and 2 read with Section 94 CPC and Section 37 of the Specific Relief Act, 1963, the court looks at prima facie case, balance of convenience and irreparable injury — the triad in Dalpat Kumar v. Prahlad Singh (1992) 1 SCC 719. A stay of a money decree under Order 41 Rule 5 uses a different checklist: sufficient cause, substantial loss, prompt application, and usually security.
Ad-interim relief
“Ad interim” is courtroom Latin for “for the intervening time”. In Hyderabad City Civil Court, Commercial Court and Telangana High Court boards, it usually means a short holding order granted on the first listing so that the subject-matter does not disappear before the other side files a counter.
Typical wording: “ad interim injunction till the next date of hearing”, or “status quo as on today until further orders”. It is not a finding that you have won the suit. It can be granted after a brief notice, or without notice if the court records why delay would defeat the object. After both sides are heard, the same relief is often continued as a regular interim order till disposal.
Ex-parte stay
An ex parte stay is a stop-order passed without hearing the person who will be restrained. In a civil suit that is almost always an exception under the proviso to Order 39 Rule 3 CPC: notice is the rule; no-notice relief needs recorded reasons that delay will defeat the injunction, plus immediate service of the papers on the opposite party.
In an appeal, Order 41 Rule 5(4) allows an ex parte stay of execution pending hearing of the stay application, subject to the safeguards in Rule 5(3). Mere filing of an appeal does not stay the decree. In a writ petition before the Telangana High Court, an “ad interim stay” of an impugned demand, recovery or administrative order is discretionary under Article 226. In recovery forums, a DRT stay under Section 17 of the SARFAESI Act is a different statute and a different test — do not plead Order 39 in the wrong building.
Side-by-side comparison
| Point | Interim order | Ad-interim relief | Ex-parte stay |
|---|---|---|---|
| Who is heard? | Usually both sides, or confirmed after notice | Often first listing; may be with or without notice | Opposite party not heard before the order |
| Typical life | Till disposal of suit / petition / appeal, or further orders | Till next date or till the IA is decided | Short; must be listed for a contested hearing |
| Usual power | O.39 Rr.1–2; O.41 R.5; Art. 226; special statutes | Same powers, used as a holding device | O.39 R.3 proviso; O.41 R.5(4); writ discretion |
| Reasoned order? | Yes — three-fold test or stay conditions | Yes — even a short board order should show urgency | Mandatory reasons if O.39 R.3 proviso is used |
| What it stops | Conduct, proceedings, or execution — depending on prayer | The immediate threatened act | The same, but on one side’s affidavit only |
| How the other side attacks it | O.39 R.4; appeal O.43 R.1(r); writ appeal in some High Courts | Same, plus pressure under Rule 3A 30-day endeavour | Vacation for non-service, no reasons, suppression |
Courts do not treat these as watertight statutory boxes. The same IA can produce an ex parte ad interim injunction on day one and a confirmed interim injunction after the counter. Read the operative paragraph, not the WhatsApp summary.
The legal tests that actually decide the first hearing
Temporary injunction — three-fold test
For Order 39 relief the court does not try the suit. It asks three questions on affidavits and documents: is there a bona fide prima facie case; who suffers more if the order is granted or refused (balance of convenience); and will damages be an adequate substitute if the threatened act happens (irreparable injury). Wander Ltd. v. Antox India Pvt. Ltd., 1990 Supp SCC 727, and Gujarat Bottling Co. Ltd. v. Coca Cola Co. (1995) 5 SCC 545 remain the appellate restraint cases: the first court has discretion; interference is limited unless the discretion is perverse.
Ex parte injunction — a higher, narrower gate
Morgan Stanley Mutual Fund v. Kartick Das (1994) 4 SCC 225 lists the factors that should weigh before an injunction is granted in the other side’s absence: whether serious mischief will follow; whether refusal would cause greater injustice than grant; how quickly the applicant moved after notice of the act; whether the applicant comes with clean hands; and whether damages would suffice. Shiv Kumar Chadha v. Municipal Corporation of Delhi (1993) 3 SCC 161 holds that recording reasons under the Rule 3 proviso is not a formality.
In Time City Infrastructure and Housing Ltd. v. State of U.P., 2025 INSC 966, the Supreme Court held that if the applicant does not comply with the Rule 3 proviso conditions — immediate delivery or registered posting of the application, affidavit, plaint and relied documents, and an affidavit of compliance the same day or the next day — the court that granted the ex parte ad interim injunction can vacate it without going into merits. That is now a first-line defence in Hyderabad IAs. Confirm the full citation against the reported text before quoting it in a pleading.
Stay of a decree — Order 41 Rule 5
An appeal does not, by itself, stay execution. The appellate court may stay for sufficient cause. Rule 5(3) asks for substantial loss if stay is refused, an application without unreasonable delay, and security for performance of the decree that may ultimately bind the appellant. Rule 5(4) still permits an ex parte stay pending hearing of that application.
Lifestyle Equities C.V. v. Amazon Technologies Inc., 2025 INSC 1190, summarised the stay-of-execution principles and treated deposit / security conditions as directory rather than an automatic knockout of the appeal. Unconditional stay of a money decree remains exceptional. Atma Ram Properties (P) Ltd. v. Federal Motors (P) Ltd. (2005) 1 SCC 705 continues to support reasonable conditions that protect the decree-holder. To be verified against the exact operative directions on your facts.
Where these applications are filed in Hyderabad and Telangana
- City Civil Court, Hyderabad — most urban property, partnership and ordinary civil IAs, with a separate court-fee on the interlocutory application.
- Junior / Senior Civil Judge and District Courts in Ranga Reddy, Medchal–Malkajgiri, Sangareddy and other districts — by territorial and pecuniary limits.
- Commercial Court at Hyderabad — commercial disputes of specified value. Section 12A pre-institution mediation may apply unless urgent interim relief is pleaded and made out. Timelines and specified-value notifications: to be verified.
- Family Courts — maintenance and incidental restraints follow Family Courts procedure, not a free-standing City Civil Court Order 39 suit.
- Telangana High Court at Hyderabad — writ petitions (Article 226) for stay of demands and administrative action; Civil Miscellaneous Appeals under Order 43 Rule 1(r); revisions and Article 227 in exceptional cases.
- DRT Hyderabad-1 / Hyderabad-2 — SARFAESI and recovery stays under the Recovery of Debts and SARFAESI framework, not Order 39.
- NCLT Hyderabad — moratorium and interim relief under the IBC / Companies Act, not a civil injunction against a CIRP.
File through the Telangana e-filing system used by the district judiciary and keep the physical paper-book ready if the registry still calls for it. Check the current court-fee schedule before numbering the IA. To be verified.
Step-by-step: how the first order is obtained
- Confirm the parent proceeding. Order 39 does not run in a vacuum. A writ stay needs a live writ. A stay of decree needs a live appeal or an application before the court which passed an appealable decree.
- Name the exact act you want stopped — sale, construction, dispossession, operation of a demand, execution of a warrant — and the exact property or account. Vague “status quo in all respects” is how both sides later swear opposite versions of the same order.
- Build the urgency bundle: registered title or contract, Dharani / RoR extract where land is involved, photographs with date, notices, bank statements, auction or demolition paper, and a chronology that shows you did not sleep on the right.
- Search for a caveat under Section 148A CPC. If the other side has caveated, an ex parte order without hearing the caveator is a gift to the vacation application.
- Draft a separate IA and a sworn affidavit. Do not hide adverse facts. Suppression is an independent ground to vacate equitable relief.
- Ask first for notice and a short date if the threat is not immediate. Ask for ad interim / ex parte relief only where delay will defeat the object, and write the reasons the judge must record.
- If an ex parte Order 39 order is granted, serve the full set the same day or the next day and file the compliance affidavit. Diary the Rule 3A thirty-day endeavour.
- On the returnable date, press for confirmation as an interim order till disposal, or for vacation if you are on the receiving end.
Documents that actually matter
- Plaint or petition with a final prayer that matches the interim prayer (perpetual injunction, setting aside of demand, setting aside of decree).
- IA with a precise prayer and a schedule of property — survey number, plot, boundaries, municipal door number, account number.
- Supporting affidavit in the first person, dated, with specific acts and dates — not adjectives.
- Title and possession papers, contract, invoices, demand, assessment order, recovery notice, or certified copy of the decree under challenge.
- Proof of urgency: photographs, lock-out, earthwork, publication of sale, attachment memo.
- Caveat search result and process-server / RPAD proof after an ex parte order.
- Undertaking as to damages where the court asks for one — common in commercial and IP boards.
- For stay of a money decree: calculation of the decretal amount, proof of substantial loss, and a workable security proposal.
After the first order: Rule 3A, Rule 4 and appeal
Order 39 Rule 3A tells the court to endeavour to finally dispose of the injunction application within thirty days of an order granted without notice, and to record reasons if it cannot. It is an endeavour clause, not a magic sunset in every reported case. Telangana High Court has set aside unreasoned, open-ended ad interim ex parte injunctions and sent the IA back for disposal within a fixed window — see the approach in Tejavath Umla (CRP 2896 of 2024) and the Division Bench treatment of the MEIL / media gag ad interim order in June 2025. Treat day 30 as a real pressure point. Local board practice: to be verified.
The person hit by an injunction can apply under Order 39 Rule 4 to discharge, vary or set aside the order, including on the ground that it was obtained by misrepresentation or concealment. A. Venkatasubbiah Naidu v. S. Chellappan (2000) 7 SCC 695 recognises that the affected party may choose Rule 4 before the same court or an appeal under Order 43 Rule 1(r) where the order is appealable. Refusal of an injunction is generally attacked by appeal, not by a second identical IA. Commercial Court appeals follow Section 13 of the Commercial Courts Act, 2015 — verify the current route on your board before choosing CMA versus Rule 4.
Breach of an injunction is not a fresh civil suit. Order 39 Rule 2A provides attachment of property and civil imprisonment as consequences. Keep proof of service of the operative order. Do not treat a police complaint as a substitute unless a separate cognizable offence is made out.
Stay versus injunction — do not plead the wrong tool
A stay operates on a proceeding, an order or a decree. An injunction operates on a person’s conduct. Clients often want both: “stay the mutation and restrain construction and freeze the account.” Those are three different prayers. Mixing them in one unreasoned paragraph is a common reason the board grants nothing.
- Subject-matter of the suit in danger — Order 39 Rules 1 and 2.
- Defendant likely to dispose of his own assets to defeat a future money decree — Order 38 Rule 5, not a status quo order.
- Decree already passed — Order 41 Rule 5 stay of execution, not a fresh injunction suit against the decree-holder.
- Bank auction under SARFAESI — Section 17 DRT application, not City Civil Court Order 39 (civil court generally barred by Section 34 SARFAESI).
- GST or income-tax recovery — statutory appeal plus stay application; writ stay only on the recognised exceptional grounds.
- Parallel civil suits on the same cause — Section 10 CPC stay of the later suit, which is not an injunction against the defendant.
How the other side vacates an ex parte or ad interim order
- Check service. No Rule 3 compliance affidavit is often enough, after Time City Infrastructure (2025), for vacation without a merits fight.
- Check reasons. An unreasoned “ad interim till further orders” is vulnerable under Shiv Kumar Chadha and local Telangana orders.
- Show suppression — prior agreement, prior possession, a pending caveat, or a material email left out of the affidavit.
- Show delay. Morgan Stanley asks when the applicant first knew of the act. A construction that has stood for months is a weak ex parte case.
- Offer an undertaking or security that removes the alleged irreparable harm without freezing the business.
- If the parent proceeding is in the wrong forum, say so first. A civil injunction against a notified SARFAESI measure wastes the first date.
Common mistakes
- Treating “status quo” as a complete prayer without defining the date and the acts frozen.
- Filing only an IA with no parent suit, appeal or writ.
- Asking for ex parte relief as a default instead of showing why notice will defeat the object.
- Not serving the Rule 3 bundle or not filing the compliance affidavit.
- Hiding a weak document and hoping the other side will not produce it on the returnable date.
- Assuming the order lasts till the suit ends. Many boards write “till the next date”. If that date is missed, the protection can fall.
- Using the High Court writ for a routine property injunction that belongs in the City Civil Court.
- Ignoring a caveat and then complaining that the order was set aside.
- Copying a Supreme Court paragraph into the affidavit instead of swearing facts.
When to consult an advocate
See counsel before the first draft if construction, a lock-change, an auction, a recovery attachment or a demolition is already in motion. The first affidavit is the case. After an ex parte order has gone against you, the clock is the Rule 3A window and the risk of Rule 2A action. After a money decree, do not assume the appeal stays execution — file the stay application with a security plan.
Bullet-point checklist
- Parent case identified: suit / appeal / writ / statutory petition.
- Correct provision named: O.39 / O.38 / O.41 R.5 / Art. 226 / special statute.
- Prayer in verbs a bailiff can enforce; schedule of property complete.
- Three-fold test pleaded with documents, not adjectives.
- Caveat search done under Section 148A.
- If ex parte is sought: reasons for delay defeating the object written out.
- If ex parte is granted: same-day or next-day service + compliance affidavit.
- Rule 3A thirty-day diary marked.
- Counter / Rule 4 vacation draft ready for the returnable date.
- Appeal route checked: O.43 R.1(r) or Commercial Courts s.13 or writ appeal.
- Forum check: not DRT / NCLT / tax appellate work dressed up as Order 39.
- Undertaking as to damages and any security proposal prepared.
Conclusion
An interim order vs ex parte stay vs ad interim relief is a question of stage, notice and power — not three different lawsuits. Use “ad interim” when you need a holding order till the next date. Use “ex parte” only when delay will defeat the object and you can live with Rule 3 service and a Rule 3A clock. Use a confirmed interim order after both sides are heard when you need protection till the case ends. Use Order 41 Rule 5 when the problem is a decree already in execution. Use the writ or the statutory tribunal when the civil court is the wrong door.
Draft the prayer in verbs the court can enforce. Serve what the proviso requires. Diary the thirty-day window. Keep the final relief alive in the parent case. And do not treat a first-date board order as a decree.

Questions
Is an ad interim order the same as a final interim injunction?
No. Ad interim is the holding order till the next date or till the IA is heard. After both sides are heard, the court may confirm it as an interim order till disposal, modify it, or vacate it. Do not assume the first line on the order sheet lasts till the decree.
Does an ex parte stay automatically lapse after 30 days?
Order 39 Rule 3A requires the court to endeavour to dispose of the application within thirty days of an injunction granted without notice, and to record reasons if it cannot. It is not drafted as an automatic expiry in every case. Some High Courts are strict when the trial court rolls the order with no reasons. Treat day 30 as a real listing target. Telangana board practice: to be verified.
Can I get an ex parte stay without filing a case?
No. The order has to sit inside a pending suit, appeal, writ or statutory petition. In a genuine emergency the parent case and the IA are filed and listed the same day. Pre-suit protection, if any, is a different remedy and is not a free-standing Order 39 application.
If the other side obtained an ex parte injunction, should I appeal or apply under Rule 4?
You usually have a choice: apply to the same court under Order 39 Rule 4, or file an appeal under Order 43 Rule 1(r) where the order is appealable. Venkatasubbiah Naidu recognises that choice. In Commercial Court matters, check Section 13 of the Commercial Courts Act before assuming you must first go back to the trial court. To be verified on the current board.
Is a stay of a bank auction an Order 39 injunction?
Generally no, if the bank is acting under SARFAESI. The civil court is ordinarily barred. The stay application belongs before DRT Hyderabad under Section 17. Using City Civil Court Order 39 against a notified measure is a common and expensive mistake.
Will filing an appeal stay the decree automatically?
No. Order 41 Rule 5 is clear. Execution continues unless the appellate court (or, in a limited window, the court which passed the appealable decree) passes a stay for sufficient cause. Plan security. Do not tell a recovery officer that “appeal is filed” and expect the warrant to stop.
What if a caveat is already on the file?
Section 148A requires the court to hear the caveator before passing an interim order so far as the caveat applies. Ignoring a caveat is a ready ground to vacate an ex parte stay. Search the caveat register before you ask the board to dispense with notice.
Can a writ court grant ad interim stay of a tax demand without pre-deposit?
Sometimes, but only on the recognised exceptional grounds — lack of jurisdiction, violation of natural justice, or a patent illegality — and the High Court often asks why the statutory appeal was not used. Pre-deposit and stay norms of the tax statute still matter. This is fact-specific and should be verified before a writ is filed as the first move.
