Builder Handover Delays: Choosing Between TG RERA and DCDRC Medchal-Malkajgiri
Forums: TG RERA (Masab Tank); Telangana RERA Appellate Tribunal; DCDRC Ranga Reddy / Hyderabad I–III as mapped; SCDRC Khairatabad; NCDRC; Telangana High Court (s.58 RERA / Art. 226 exceptional).
Introduction
If your builder in Hyderabad or Medchal-Malkajgiri has missed the promised handover date, the first practical question is not “which law sounds stronger” but consumer court vs RERA Hyderabad — and which forum you should lock in now. For a flat in Kompally, Bachupally, Kukatpally, Alwal, Gajularamaram or Dundigal, both TG RERA and a DCDRC Medchal builder complaint (or the Hyderabad / Ranga Reddy commission that currently hears Medchal matters) can work. They are not the same case, they do not give identical relief, and after a 2026 Supreme Court ruling you generally cannot hop from one forum to the other for the same delay.
This guide is for homebuyers, borrowers servicing a home loan on an unfinished flat, and small-business owners who booked an apartment as an investment. It covers when a flat possession delay notice helps, what to file, where to file, what evidence matters, and the mistakes that quietly kill a good claim.
What a builder handover delay actually is
A handover delay is not “the tower looks unfinished.” It is a legal default against a date you can prove. That date usually comes from the registered agreement for sale; the allotment letter or booking form if no sale agreement was executed; the possession clause plus any written grace period; and the RERA-registered completion or possession timeline on the project page.
Until the promoter offers lawful possession — typically after an occupancy certificate or equivalent completion permission — the clock for delay interest or refund keeps running. A “fit-out letter,” a demand for extra charges, or a request that you take “symbolic” keys without an occupancy certificate is not a clean handover. Record that in writing.
Force majeure and COVID-era extensions are not an automatic free pass. TG RERA has, in recent orders, allowed only the extension that the Authority itself granted or that the contract and law actually support. A builder cannot keep rolling the date by circulars you never agreed to.
When this problem applies in Medchal-Malkajgiri
Typical Medchal-Malkajgiri fact patterns:
possession date in a 2022–2024 agreement has passed, and the site is still at structure or finishing stage;
RERA registration was extended, but your individual flat is still not offered with an occupancy certificate;
the promoter asks for GST, club-house, corpus or “amenity” amounts before giving keys;
the project is stalled, the company is unresponsive, or construction has stopped;
you want either keys plus delay interest, or a full refund with statutory interest.
If the builder is already in CIRP before NCLT Hyderabad, strategy changes. RERA and consumer orders may still exist, but recovery often has to travel through the insolvency claim process. Get that checked before you spend months in the wrong queue.
First, a practical warning on the “Medchal DCDRC” label
People search for “DCDRC Medchal builder complaint” because that is the district in which they live or in which the tower stands. Section 28 of the Consumer Protection Act, 2019 requires a District Commission in every district. Telangana has not historically maintained one in every district created after reorganisation.
The Telangana High Court in November 2025 directed the State to decide on constituting commissions in the 23 districts created after reorganisation. The India Justice Report 2026 still recorded only about 12 functioning district commissions for the whole State. In practice, Medchal-Malkajgiri project complaints have often been numbered before DCDRC Ranga Reddy or transferred to a Hyderabad District Commission.
Forums nearest to Medchal-Malkajgiri residents (verify the live e-Jagriti map before you file):
District Consumer Disputes Redressal Commission, Ranga Reddy — District Court Compound, NTR Nagar, L.B. Nagar, Hyderabad – 500074.
Hyderabad District Commissions I, II and III — Chandra Vihar Complex, M.J. Road, Nampally, Hyderabad – 500001.
Telangana State Consumer Disputes Redressal Commission — Eruvaka Building, Anandnagar, Khairatabad, Hyderabad.
Section 34(2) of the 2019 Act also lets you file where you reside or personally work for gain. Before you print letterheads saying “DCDRC Medchal-Malkajgiri,” open e-Jagriti (e-jagriti.gov.in), select Telangana, and see which district commission is actually accepting Medchal / Kompally / Kukatpally filings that week. Filing in a commission that will return the papers wastes limitation.
Two forums, one choice
TG RERA (Hyderabad)
Law: Real Estate (Regulation and Development) Act, 2016, and the Telangana Real Estate (Regulation and Development) Rules, 2017.
Office: Telangana Real Estate Regulatory Authority, DTCP Building, Ground Floor, 640, A.C. Guards, Masab Tank, Hyderabad – 500004. Phone commonly listed: 040-29394973. Confirm on rera.telangana.gov.in.
Portals: rera.telangana.gov.in and the complaints portal linked from it (complaints-rera.telangana.gov.in). Confirm the live URL and fee before you pay.
Who hears what — following Newtech Promoters and Developers Pvt. Ltd. v. State of Uttar Pradesh (2021) 18 SCC 1:
Form M (Rule 34) — complaint to the Regulatory Authority under Section 31 for refund, delay interest, a direction to complete and hand over, and regulatory directions.
Form N (Rule 35) — complaint to the Adjudicating Officer under Section 71 for compensation under Sections 12, 14, 18 and 19 (false advertisement, structural deviation, delay loss beyond interest, information failures).
Do not dump “compensation for mental agony” into Form M and assume the Authority will quantify it. Split the prayers the way the statute splits the officers.
Core buyer right — Section 18
if you withdraw, claim refund of amounts paid plus interest;
if you stay in the project, claim interest for every month of delay until actual handover.
Interest in Telangana is fixed by Rule 15: SBI highest Marginal Cost of Lending Rate plus two per cent per annum. Recent TG RERA refund and delay-interest orders have applied rates in the 10.75%–10.85% band depending on the then-prevailing MCLR. Use the live SBI figure on the date of calculation. Do not invent a flat 12% or 18% in the RERA prayer unless a later court awards a different rate on different facts.
Why buyers pick TG RERA
the Authority already has the project file, registration, quarterly updates and extension history;
refund plus Rule 15 interest is a structured, repeatable prayer;
orders can also push the promoter on completion, advertising and account compliance;
a promoter who appeals to the Telangana Real Estate Appellate Tribunal generally faces the pre-deposit under Section 43(5) (penalty, or the amount payable to the allottee). That pressure is useful.
Appeals: 60 days to the Appellate Tribunal under Section 44 (delay can be condoned for sufficient cause). Thereafter, a statutory appeal lies to the Telangana High Court under Section 58 on a substantial question of law. Filing fees on the live portal are commonly quoted around ₹1,000 for an Authority complaint and ₹5,000 for an adjudicating-officer complaint — verify the amount shown at the time of payment.
Consumer commission (Medchal / Hyderabad buyers)
Law: Consumer Protection Act, 2019 — deficiency of service and unfair trade practice against a builder as a service provider or product seller of a constructed unit.
Pecuniary jurisdiction (verify before filing): the 2021 Jurisdiction Rules — still the working bands in 2026 — value the case on consideration paid, not on compensation claimed. The Supreme Court upheld that “consideration-centric” test in Rutu Mihir Panchal v. Union of India, 2025 INSC 593 (29 April 2025). The original 2019 Act text quoted higher slabs; do not use those figures.
| Commission | Consideration paid | What it hears |
|---|---|---|
| District Commission (DCDRC) | Up to ₹50 lakh | Original complaints only |
| State Commission (SCDRC), Khairatabad | Above ₹50 lakh up to ₹2 crore | Original complaints + appeals from District |
| National Commission (NCDRC), New Delhi | Above ₹2 crore | Original complaints + appeals from State |
Working slabs under the 2021 Jurisdiction Rules. Confirm on e-Jagriti on the date of filing.
A ₹1.2 crore flat on which you have paid ₹42 lakh is a District matter if consideration paid is the test. Inflating “mental agony” to reach NCDRC is a 1986-Act habit. It is the fastest way to have the complaint returned.
Limitation is Section 69: two years from the date the cause of action arose, with condonation only if you show sufficient cause and the commission records reasons. For a continuing failure to hand over, many benches treat the default as alive — but do not gamble on that. File within two years of the contractual possession date unless your advocate has a documented continuing-cause theory.
From 1 January 2025 the older e-Daakhil and Confonet systems were folded into e-Jagriti (e-jagriti.gov.in). That is the live portal for filing and tracking.
Why buyers pick the consumer commission
compensation, costs and “deficiency” findings sit naturally here;
you can sue where you live;
unfair-contract and misleading-promise pleadings are familiar to the forum;
execution follows the consumer-commission process, which some allottees find easier to chase locally.
The cost of that choice: Telangana district and State commissions are slow. IJR 2026 put average DCDRC disposal in the State at well over a year, and SCDRC near 1,000 days. RERA’s statutory endeavour is 60 days. Neither figure is a guarantee.
Can you file both? The 2026 election rule
Older Supreme Court law still matters:
Imperia Structures Ltd. v. Anil Patni (2020) — Section 79 of RERA bars civil courts, not consumer commissions.
Experion Developers Pvt. Ltd. v. Sushma Ashok Shiroor (2022) — RERA and the Consumer Protection Act are concurrent; neither has primacy.
Pioneer Urban Land and Infrastructure Ltd. v. Union of India (2019) — RERA, consumer law and the IBC occupy different fields.
What changed in 2026 is the doctrine of election. In M/s Kabra and Associates v. Rekha Rajkumar Hemdev (Supreme Court, February / March 2026; Justices Sanjay Kumar and K. Vinod Chandran), homebuyers who had first gone to RERA, then withdrawn with liberty to refile before RERA, were not allowed to switch to NCDRC for the same dispute. The Court relied on Ireo Grace Realtech Pvt. Ltd. v. Abhishek Khanna (2021).
| Practical translation for a Hyderabad buyer You may choose TG RERA or the consumer commission. You should not run the same refund or possession cause of action in both. If you have already filed Form M, think very hard before you withdraw and “try consumer court instead.” If the prayers are truly different — for example a regulatory completion direction in RERA and a distinct product-defect claim after handover — an advocate can test whether they are separate causes. Do not invent that distinction yourself. |
|---|
How to choose: a working rule
| Your real objective | Better first forum | Why |
|---|---|---|
| Walk away and get money back with statutory interest | TG RERA Form M | Section 18 + Rule 15 is built for this |
| Stay in the project, collect delay interest, force completion | TG RERA Form M | Project file and directions sit with the Authority |
| Compensation for false brochure, layout change or consequential loss | Form N and / or consumer commission | Newtech split; consumer forum is comfortable with damages |
| Consideration paid ≤ ₹50 lakh; local deficiency case | District Commission (verify mapping) | Residence jurisdiction + compensation |
| Consideration paid ₹50 lakh–₹2 crore | SCDRC Telangana, Khairatabad | Pecuniary band under the 2021 Rules |
| Builder is a serial defaulter across many towers | TG RERA | Regulator can act beyond your single flat |
| Project looks abandoned / company vanishing | TG RERA first; insolvency advice in parallel | Refund order is useful; CIRP may overtake execution |
There is no single “winning” forum. There is a forum that matches the prayer you can prove.
Flat possession delay notice — draft it before you file
A notice is not a statutory pre-condition for a Section 31 RERA complaint or a consumer complaint. It is still worth sending. Send it by RPAD and email to the promoter’s registered office, the authorised signatory on the agreement, the RERA-registered project address, and the customer-care ID used on payment receipts.
Ask the notice to record:
Project name, RERA registration number, tower and flat.
Agreement date and contractual possession date (with grace, if any).
Amounts paid, with dates and mode.
Present site status as you have seen it.
- Your election: refund with Rule 15 interest, or possession plus delay interest.
Fifteen days to comply.
- That you will approach TG RERA or the competent consumer commission without further notice.
Do not threaten criminal cases you will not file. Do not admit that you accepted a revised date unless you did.
Documents that actually move the case
Booking form, receipts, bank statements and home-loan disbursement letters.
Agreement for sale or builder-buyer agreement (registered copy).
Allotment letter and demand letters.
Emails, a WhatsApp export from the original phone, brochure and website printouts.
TG RERA project snapshot — registration number, registered possession date, extensions.
Site photographs with date, and if possible a short video of the unfinished tower.
Occupancy or completion application status, if you have it from GHMC or the relevant municipal body.
Calculation sheet: amount paid × Rule 15 rate × period of delay.
Identity and address proof for the e-Jagriti or RERA login.
Board resolution or authorisation if a firm is the complainant — and first check the commercial-purpose bar under the 2019 Act.
Vague pleadings without dates and amounts fail at scrutiny. Both forums decide largely on documents and affidavits. Keep originals; upload only true copies.
Step-by-step: TG RERA complaint
Download the live project card. Note the registration number, the promoter name as registered (not the marketing brand), and the last extension.
Decide Form M, Form N, or both as separate filings.
Compute refund or delay interest on Rule 15. Show the working.
Create a login on the official complaints portal. Upload a paginated PDF set.
Pay the prescribed fee shown on the portal. Save the acknowledgement, complaint number and payment reference.
Watch the cause list. Attend or instruct an advocate. Do not ignore a direction to file a rejoinder.
If you win and the promoter does not pay, move execution or recovery as permitted under the Act and the Authority’s procedure. If the promoter appeals, track the Section 43(5) pre-deposit.
Statutory endeavour for disposal is 60 days. Budget for longer.
Step-by-step: consumer complaint (Medchal / Hyderabad)
Add up consideration actually paid. Pick District, State or National under the 2021 Rules.
Confirm the live commission on e-Jagriti for your district and residence.
Draft the complaint with dates, deficiency, and a prayer that matches the Act (refund, possession, compensation, costs). Attach a limitation paragraph.
File on e-Jagriti or at the commission’s filing counter. Pay the scheduled consumer court fee — not Telangana civil court-fee stamps.
Serve the opposite parties. Keep proof.
Mediation may be offered. Do not settle a refund at a figure below your documented principal plus a reasoned interest claim unless you have a cash-in-hand reason.
Section 40 review before the same District Commission is 30 days for an error apparent on the face of the record. Section 41 appeal to SCDRC Khairatabad is 45 days from the order. If the appellant is the opposite party, a pre-deposit (commonly 50 per cent of the amount awarded) applies — verify the current statutory figure on the certified copy you receive. Further appeal lies to NCDRC under Section 51.
RERA has no express limitation clause in Section 31. High Courts and authorities are not uniform: some treat three years as a reasonable outer mark; the Chhattisgarh High Court in 2026 held that the Limitation Act does not apply to a Section 31 complaint. Do not sleep on the claim. File while the default is fresh and the documents are complete. To be verified on Telangana practice before you rely on a late filing.
Common mistakes that lose Medchal delay cases
Filing RERA and consumer court on the same refund prayer after Kabra (2026).
Using the old ₹1 crore District Commission figure.
Adding compensation to consideration to “reach” NCDRC.
Naming the marketing LLP when the registered promoter is a different company.
Selecting Hyderabad-I on e-Jagriti when residence and the project sit in Medchal and the live map points to Ranga Reddy.
Taking keys and signing a “no dues / no claim” letter, then asking for delay interest.
Paying extra corpus or GST under protest but with no email trail.
Claiming 18% interest in RERA when Rule 15 is MCLR + 2%.
Ignoring an IBC public announcement against the promoter.
Treating an unregistered project as “outside RERA.” Failure to register is often a RERA violation; it is not a promoter’s shield.
Missing the two-year consumer clock and filing without a condonation application.
When to consult an advocate
More than one company signed the papers (landowner + developer + marketing entity).
You have already filed and withdrawn a RERA complaint.
Consideration paid sits near the ₹50 lakh or ₹2 crore line.
The builder has offered a one-time settlement or a shifted flat.
An occupancy certificate is issued but finishing, parking or undivided share is short.
A home loan is in default because the flat cannot be mortgaged as complete.
You need an interim direction against a threatened cancellation or third-party sale.
Forum choice is a one-way door after 2026. Pay for that one-hour review before you file.
Bullet-point checklist
Contractual possession date and any written grace period marked on a one-page chronology.
RERA registration number and last extension printed from the official portal.
All payments listed with date, amount, mode and bank UTR.
Decision recorded in writing: refund, or possession plus delay interest — not both as your primary case theory unless the pleading explains the alternative.
Forum chosen: TG RERA Form M / Form N, or the correct consumer commission on consideration paid.
Confirmed on e-Jagriti that Medchal matters are being taken by the commission you named.
Flat possession delay notice sent RPAD + email; postal receipt filed.
Rule 15 working (SBI highest MCLR + 2%) attached.
No parallel case on the same cause of action.
Limitation note for Section 69 if you are in the consumer commission.
Originals kept; only true copies uploaded.
Advocate vakalat and contact details on the first filing if you are not appearing in person.
Conclusion
A missed handover in Medchal-Malkajgiri is a document case, not an argument case. Fix the possession date, fix the amounts paid, then choose TG RERA if you want structured refund or delay interest tied to the project file, or the competent consumer commission if your claim is a classic deficiency or compensation case within the 2021 pecuniary bands. Send a clean flat possession delay notice, file once, and do not switch forums mid-stream after the 2026 election ruling. Verify the live Medchal DCDRC mapping and the live Rule 15 rate on the day you file.

Questions
Is consumer court vs RERA Hyderabad a real choice, or has RERA replaced the consumer commission?
It is a real choice. RERA did not repeal consumer jurisdiction. After Kabra (2026), it is an election, not a buffet.
I live in Medchal-Malkajgiri. Must I file only a DCDRC Medchal builder complaint?
No. You may file where you reside, where the builder has an office, or where the project sits. Also check whether a dedicated Medchal commission is actually functioning. Many Medchal flats have been heard at Hyderabad-II or Ranga Reddy.
Can I send a flat possession delay notice and wait?
Yes, for 10–15 days. Do not wait months. Consumer limitation is two years. RERA has no express limitation clause, but delay still hurts credibility.
What interest will TG RERA give me?
Rule 15 — SBI highest MCLR plus 2%, not a number you pick from a WhatsApp group.
The project is not RERA-registered. Is consumer court my only option?
No. Non-registration can itself be a RERA contravention. Consumer court remains available if you are a consumer and limitation and pecuniary limits are met. Map both on facts.
I already took possession. Can I still claim delay interest?
Often yes, if you did not sign away the claim. Conveyance or keys do not automatically wipe past delay. The document you signed at handover is the risk. Wg. Cdr. Arifur Rahman Khan v. DLF Southern Homes (2019) 8 SCC 512 is commonly cited for the point that taking possession does not by itself extinguish a delay claim — apply it only after reading your handover papers.
How long will each case take?
RERA aims at 60 days and often overruns. Telangana consumer commissions, on published 2026 capacity data, frequently take more than a year at District level and longer at State level. Plan cash flow on the slow number.
The builder wants me to accept a new date against a small waiver. Should I?
Only in writing, only after you calculate Rule 15 interest already accrued, and only if the new date is backed by a revised RERA timeline. A verbal “two more months” has no value in Form M.
