Regularisation of Unapproved Layouts (LRS) in Telangana: Court Directives & Legal Validity

Regularisation of Unapproved Layouts (LRS) in Telangana: Court Directives & Legal Validity
A practical guide for plot owners, buyers, borrowers and litigants in Hyderabad, Medchal–Malkajgiri and Telangana
Introduction
LRS regularisation legal status in Telangana is the first question every buyer of an unapproved plot in Hyderabad, Medchal–Malkajgiri or the HMDA belt should ask. A registered sale deed does not, by itself, make the layout planning-compliant. Without regularisation or an approved layout, building permission, municipal services and a clean onward sale can all stall.
The Layout Regularisation Scheme (LRS) under G.O.Ms.No.131, Municipal Administration and Urban Development Department, dated 31 August 2020, is the State’s policy route to bring old unapproved layouts into the planning fold. It is not a title-curing statute. It does not legalise government, assigned, endowment, waqf, water-body or public-utility land. Court orders from 2022 through 2026 show two parallel tracks: processing of eligible 2020 applications, and writ litigation when a Sub-Registrar refuses open-plot registration or a municipality rejects a building permit.
This guide is for plot owners, buyers, borrowers and litigants in Hyderabad and Telangana. It explains when LRS applies, what the 26 August 2020 cut-off actually means, how open-plot registration works in Medchal practice, which lands stay ineligible, and when a writ before the Telangana High Court is the practical next step.
What an unapproved layout means in practice
An unapproved or illegal layout is land carved into plots and sold without sanction from the competent planning authority — HMDA, DTCP, an Urban Development Authority, a Municipal Corporation, a Municipality or, in rural limits, the authority required under planning law. A Gram Panchayat “approval” without the required technical clearance is treated as unapproved for LRS purposes.
The sale deed may be registered. The pattadar passbook may stand in your name. The plot may even have a compound wall. None of that answers the planning question. Banks, TS-bPASS and most buyers treat an unregularised plot as high risk.
LRS was designed to regularise the plot so that civic works can follow and building permission can be considered. It does not regularise an unauthorised building. That is a separate building-regularisation issue.
Legal framework you must check first
The working framework, as of September 2026, is a chain of government orders and registration instructions. Current G.O. text and portal status should be verified on the facts of your plot.
• G.O.Ms.No.131, MA&UD, 31.08.2020 — Telangana Regularization of Unapproved and Illegal Layout Rules, 2020. Statewide. Cut-off logic is tied to documents existing as on 26 August 2020.
• G.O.Ms.No.135, MA&UD, 16.09.2020 — revised regularisation-charge slabs (linked to market value as on 26.08.2020) and pro-rata open-space charges at 14% of plot value where the layout does not have the required 10% open space.
• C&IG Memo No. G2/257/2019 dated 26.08.2020 — registration instruction that no new plot or sub-division should be registered unless approved by the competent authority. This memo is still cited by Sub-Registrars in Medchal, Keesara, Shamirpet, Quthbullapur and adjoining offices.
• G.O.Ms.No.28, MA&UD, 20.02.2025 — important 2025 amendment. Unregistered plots that form part of an unauthorised layout in which at least 10% of plots were already sold by registered sale deed on or before 26.08.2020 may be permitted for registration on collection of layout regularisation charges and pro-rata open-space charges, whether or not those owners had applied under LRS 2020. A time-bound 25% rebate on charges was offered for payments by 31 March 2025 (later reporting referred to an April 2025 outer date — verify the exact window that applied to your file).
• G.O.Ms.No.98, MA&UD, 15.05.2025 — further amendment to cover alienation by gift, exchange or succession in addition to sale (verify current text before relying on it).
Official status is checked on lrs.telangana.gov.in and, for HMDA-area plots, lrsbrs.hmda.gov.in. An acknowledgement number is not a regularisation proceeding.
| Verify before you pay Charge tables, rebate windows and portal processing stages have moved more than once since 2020. Confirm the live G.O. and the demand notice on your acknowledgement before transferring regularisation or open-space charges. |

Who can seek LRS — and who cannot
Typically eligible (subject to rules and site scrutiny)
• Plot held under a registered sale deed / title deed dated on or before 26.08.2020.
• Layout developer who had sold at least 10% of plots by registered deed on or before that date.
• After G.O. 28/2025, remaining unregistered plots in such a 10%-sold layout, on payment of prescribed charges at the Sub-Registrar / LRS portal route.
• Individual plots even if the whole layout does not apply together — official FAQs allow plot-wise regularisation, subject to road width, open-space and land-classification checks.
Typically ineligible or high-rejection risk
• Plots first created or first registered after 26.08.2020 in a layout that never met the 10% pre-cut-off sale test.
• Open spaces, parks or roads of an approved layout later carved into saleable plots.
• Land already gifted to the local body for roads or public use.
• Water bodies, FTL, buffer, shikam, nalas and plots falling on notified Master Plan roads.
• Government land, assigned land, surplus ceiling land, endowment and waqf property.
• Property on the Section 22-A prohibited list.
• Public-utility land. In June 2026 the Telangana High Court (Justice Alishetty Lakshminarayana, K. Kamalamma, Kukatpally) held that land earmarked for public purposes is not eligible for LRS, while also holding that a registered sale deed cannot be cancelled unilaterally without notice, consent or a court order.
A pending LRS file does not freeze a prohibition. Revenue, irrigation and prohibited-list objections still kill files at L1/L2 scrutiny.
Open plot registration in Medchal: what actually happens
Medchal–Malkajgiri is one of the densest unapproved-layout belts around Hyderabad. Buyers routinely face three Sub-Registrar responses:
Document kept pending, then refused under the 26.08.2020 C&IG memo as a “new plot / unauthorised layout”.
Link-document objection — vendor’s prior registered title not produced to the SRO’s satisfaction.
Section 22-A / prohibitory list / water-body objection — a different and often harder bar.
G.O. 28/2025 was meant to unlock registration of leftover plots in old 10%-sold layouts, with LRS charges collected at the registration stage and data pushed to the LRS portal. Implementation is uneven. Some offices still refuse first and wait for a High Court direction.
The Supreme Court in K. Gopi v. The Sub-Registrar, 2025 INSC 462 (7 April 2025), held that a registering officer’s job is procedural. He cannot refuse registration merely because the vendor’s title is not “established” before him. The Telangana High Court applied that principle in Damuluri Tejaswini (W.P. No. 9169 of 2026, 26 March 2026) together with G.O. 28, and directed registration of a pending document subject to payment of LRS charges.
That does not mean every Medchal open plot must be registered. K. Gopi does not erase Section 22-A, water-body restraints, or a lawful planning-law bar on new illegal sub-division. It helps when the only ground is “produce the vendor’s title to our satisfaction” or a mechanical “unauthorised layout” stamp on a plot that already sits inside a pre-2020 10%-sold layout.
Practical sequence for a Medchal buyer or seller
Pull EC, link deeds, layout sketch, LRS acknowledgement (if any) and Section 22-A / Bhu Bharati status.
Confirm whether 10% of that layout was registered on or before 26.08.2020.
Present the deed with a written representation citing G.O. 28/2025 and, if relevant, K. Gopi.
If refused under Section 71 of the Registration Act, take the statutory appeal / revision path and consider a writ if the refusal is mechanical.
Do not treat registration as a substitute for LRS proceedings or building permission.
Building permission on an unregularised plot
Official LRS FAQs are blunt: no regularisation, no building permission, and no extension of roads, water or street lights as a matter of scheme policy.
In practice, Hyderabad and district municipalities also collect LRS-equivalent charges inside the TS-bPASS / building-permit file. A 10 December 2020 MA&UD memo (discussed in later High Court orders) created two processing buckets for pre-cut-off deeds: (i) LRS applied — collect LRS charges on the acknowledgement; (ii) LRS not applied — collect basic LRS penal charges plus 33% compounding plus 14% open-space contribution on current market value.
The harder category is a sale deed after 26.08.2020. In W.P. No. 5150 of 2022 (2 February 2022) the High Court noted that the 2020 Rules gave no formula for post-cut-off deeds, and directed consideration of building permission on LRS charges + 33% compounding + 14% open-space charges. That direction has been followed in later single-judge orders, including Katta Rama Devi (W.P. No. 7224 of 2026, 10 March 2026) and M/s SRR Golden Homes (W.P. No. 13386 of 2026, 28 April 2026).
A 2023 Division Bench dismissal of some writ appeals on cut-off building-permission claims shows the line is not uniform. Treat post-cut-off building permission as fact-specific and verify the latest coordinate-bench position before filing.
An LRS proceeding plus building permit still does not decide ownership. Title disputes go to the civil court.
Court directives and legal validity — what is settled
• LRS is a policy scheme, not a vested right. Filing an application and paying ₹1,000 does not entitle you to regularisation at a frozen 2020 rate, or by a date of your choice. The State can amend charges and process before a final proceeding issues.
• Regularisation is not available for public streets and reserved open space. Once roads and open spaces are transferred to the local body, the developer cannot sell them and then seek LRS. The June 2026 Kukatpally ruling is the clean statement of that limit.
• A granted LRS is not easily recalled on a late “fraud” theory if the authority already knew the open-space shortfall and collected pro-rata charges. In August 2026 a Division Bench (GHMC v. Siri Constructions / Darshinee Infra Projects, 2026 LiveLaw (Tel) 136) refused to condone GHMC delays of 794 and 820 days and found little prima facie fraud where GHMC had itself regularised plots knowing they sat in the open-space shortfall of an unapproved layout.
• Unilateral cancellation of a registered sale deed is not a shortcut. The same June 2026 ruling reiterated that cancellation needs notice and consent, or a competent court order.
• Registration and LRS are different legal acts. Registration records a transaction. LRS is a planning regularisation. K. Gopi limits the SRO’s title enquiry; it does not convert an ineligible layout into an approved one.
• Civil court versus writ. Title, partition, cancellation of deed and possession stay in the civil court. Refusal of registration, rejection of LRS, or rejection of building permission is generally a Telangana High Court writ (Article 226), after you have used the portal / representation route. A civil suit does not, by itself, force HMDA or GHMC to issue LRS.
Documents that decide the file
Keep a single indexed set. Missing one item is how Medchal files stall for months.
• Registered sale deed and full link documents up to patta / mother deed.
• Encumbrance certificate (13-year and 30-year as relevant).
• Layout plan / brochure / approved plan if any, with plot number matching the deed.
• LRS acknowledgement, fee receipts, demand notice, rejection letter or proceeding.
• Market-value / card-value extract used for charges.
• Revenue records: pahani, PPB/title deed, Bhu Bharati extract.
• FTL / irrigation / revenue NOC trail if the plot is near a water body (files within about 200 metres are routed through revenue and irrigation — verify the current circular distance).
• Section 22-A / prohibited-list printout.
• Photographs, compound-wall tax receipts, electricity or water bills — useful, not conclusive.
• If litigating: SRO refusal order under Section 71, building-permit rejection, and proof of representation.
Forums, timelines and limitation
| Issue | First stop | Next forum | Time pressure |
|---|---|---|---|
| Pending LRS file / fee demand | lrs.telangana.gov.in / HMDA / ULB | Representation to Commissioner / Metropolitan Commissioner; then writ | 2025 rebate windows closed; current demand follows latest G.O. — verify |
| Open-plot registration refused | Sub-Registrar (Medchal / concerned SRO) | District Registrar / IG; writ to Telangana High Court | Act immediately; delay looks like waiver |
| Building permit rejected on “no LRS / post-cut-off deed” | TS-bPASS / municipality | Writ relying on W.P. 5150/2022 line — outcome not guaranteed | Writ is governed by laches; do not wait years |
| Title / rival sale / cancellation | Civil court of competent value | Appeal | Usually 3 years for cancellation / declaration — compute from knowledge |
| Prohibited-list / Section 22-A | Collector / SRO grievance | Writ; civil declaration if title is disputed | Separate from the LRS clock |
There is no single “LRS limitation period” that creates title. What expires is the scheme window and any rebate. After that you still own the plot — you simply remain outside the planning system until a later policy or a court direction says otherwise.
Common mistakes that cost buyers in Hyderabad
• Treating an LRS acknowledgement as approval.
• Buying after 26.08.2020 on the pitch “we will regularise later”. Official FAQs say that route is closed for fresh post-notification purchases.
• Ignoring 14% open-space charges. On high card-value Medchal land this can exceed the plot’s “discount” versus an approved layout.
• Not checking whether the plot was originally a layout road or park.
• Not running Section 22-A and FTL checks before paying token money.
• Assuming a bank will mortgage an unregularised open plot.
• Cancelling a sale deed at the SRO to “undo” a bad plot — cancellation without court process is vulnerable.
• Filing a writ without the refusal order, layout map and 10% pre-cut-off sale proof. The Court cannot invent those facts.
When to consult an advocate
Speak to counsel before you pay the balance or sign a sale agreement if:
• the SRO has issued a written refusal;
• the plot is near a lake, nala or Master Plan road;
• LRS status is “rejected”, “ineligible” or stuck at revenue/irrigation;
• you hold only a post-26.08.2020 deed and need building permission;
• the seller is offering a GPA / unregistered agreement instead of a registered deed;
• there is a prior LRS proceeding in someone else’s name;
• a bank has flagged the layout in a loan query.
Checklist
• Confirm whether the layout has an HMDA / DTCP / ULB sanction number. If yes, you do not need LRS.
• If unapproved, pull LRS status on the official portal with acknowledgement number and mobile.
• Check sale-deed date against 26.08.2020.
• Check whether 10% of the layout was registered before that date (G.O. 28/2025 route).
• Run EC, 22-A list, Bhu Bharati, FTL/buffer and assigned-land checks.
• Budget regularisation slabs plus 14% open-space where the layout is short of open space.
• Do not pay “full extra” cash to a broker promising portal approval.
• For Medchal registration: representation + G.O. 28 + charge-payment readiness + K. Gopi only if the objection is title-enquiry / mechanical layout stamp.
• Keep originals; file certified copies in any writ.
• Re-verify current G.O.s and portal fee before payment.
Conclusion
LRS regularisation legal status in Telangana is best understood as a conditional planning amnesty, not a blanket legalisation of every open plot sold around Hyderabad. The 26 August 2020 cut-off, the 10% pre-cut-off sale test under G.O. 28/2025, land classification, and a final paid proceeding decide whether your plot can be registered onward and built upon.
Medchal open-plot registration is workable in defined old layouts if charges are paid and the land is not prohibited. It remains a litigation zone where Sub-Registrars apply the 2020 registration memo strictly. Use the portal, keep the paper trail, and move the High Court only with the refusal order and layout facts in hand. An approved HMDA or DTCP layout is still the cleaner asset if you have a choice.

Questions
What is the LRS regularisation legal status in Telangana in 2026?
The 2020 Rules remain the base policy, amended in 2025 (notably G.O. 28 and G.O. 98). Lakhs of 2020 applications are still under process. A final paid proceeding is what matters. An application or pending status is not legal clearance.
Can I register an open plot in Medchal if the layout is unapproved?
Only if you fit an exception — typically a plot already in the registered chain, or a leftover plot in a layout where 10% was sold on or before 26.08.2020, with LRS and open-space charges paid as per G.O. 28/2025. Many SROs still refuse first. A writ may be required. Section 22-A and water-body bars survive.
I bought the plot after 26 August 2020. Can I apply for LRS?
Official FAQs say no for a purchase after notification. Some High Court single-judge orders have still directed building permission on payment of LRS-equivalent penal charges plus compounding. That is not the same as a fresh LRS certificate. Verify the latest bench position for your municipality.
Does LRS give me marketable title?
No. It is planning regularisation. Title still depends on the vendor’s title, revenue classification and absence of a prohibited-list cloud. Registration plus LRS is stronger than a bare unapproved deed — it is not a government title guarantee.
Can roads and park plots in a layout be regularised?
Generally no. Official FAQs and the June 2026 High Court ruling on public-utility land go against regularising reserved open space or roads, especially after gift to the local body.
The municipality rejected my building plan only because LRS is pending. What next?
File a representation with the LRS acknowledgement and offer to pay LRS / 33% compounding / 14% open-space charges as applicable. If still rejected, a writ before the Telangana High Court is the usual remedy. Outcome depends on deed date, land classification and the current case-law line.
Is demolition automatic if I never applied for LRS?
Scheme consequences are refusal of permission and services, not an automatic demolition order in every case. Separate building-violation and encroachment proceedings can still run. Do not assume immunity.
Which court do I approach for unapproved layout litigation in Hyderabad?
Telangana High Court at Hyderabad for LRS rejection, SRO refusal and building-permit rejection. City Civil Court / District Court for title, injunction and deed cancellation. Collector / Tahsildar for revenue and 22-A issues. Do not file all three on the same day without a strategy — inconsistent pleadings hurt later.
