Filing a Complaint Before TG RERA: Delay in Flat Handover and Refund Procedure
A practical guide for homebuyers, borrowers and litigants in Hyderabad and Telangana on Form M / Form N, Section 18 refund, Rule 15 interest and TREAT appeal
Introduction
If your Hyderabad or Telangana builder has missed the promised handover date, a TG RERA complaint filing Hyderabad is often the fastest statutory route for a builder delay refund Telangana. Under the Real Estate (Regulation and Development) Act, 2016, an allottee can ask Telangana RERA either to return the money with prescribed interest or to keep the flat and claim delay interest until lawful possession.
This guide is for homebuyers, co-allottees, borrowers who paid towards a booked unit, and Hyderabad litigants who need a practical map: which form to use, which documents matter, how interest is worked out, and when a RERA advocate Hyderabad should step in.
Outcomes still turn on your agreement, payment record, occupancy-certificate status and whether the project is registered. Verify live portal fees and cause lists before you file. Nothing in this article is a guarantee of refund or possession.
What a Delay-in-Handover Complaint Actually Covers
Telangana Real Estate Regulatory Authority (TG RERA / TGRERA) sits at the DTCP Building, Ground Floor, 640, A.C. Guards, Masab Tank, opposite PTI Building, Hyderabad – 500004. Phone numbers published on the official site have included 040-29394973 and WhatsApp 9000006301 — verify current contact details on rera.telangana.gov.in. Complaints are started online, not by walking in with a paper bundle.
Typical delay disputes include:
The possession date in the agreement for sale has passed, with or without a contractual grace period.
The project is stalled, registration has lapsed, or the promoter cannot show a credible completion path.
An “offer of possession” is issued without an occupancy certificate, or with pending amenities that were part of the registered disclosures.
You want to exit and recover every rupee paid, or you want to stay and be paid delay interest until handover.
Section 18 is the core provision. If the promoter fails to complete the project or cannot give possession as agreed, the allottee may withdraw and demand return of the amount with interest at the rate fixed by the State Rules, and may also claim compensation. If the allottee does not withdraw, the promoter must pay interest for every month of delay until possession. Section 19(4) mirrors the allottee’s right to refund with interest on the same facts.
The Supreme Court in Imperia Structures Ltd. v. Anil Patni (2020) treated the refund right as unqualified when possession is not given by the agreed date, and held that consumer-forum remedies run concurrently with RERA. In Newtech Promoters and Developers Pvt. Ltd. v. State of U.P. (2021) the Court split the work: refund and statutory interest go to the Regulatory Authority; compensation goes to the Adjudicating Officer.
Refund or Stay in the Project: Choose the Prayer First
Do not file a mixed, vague prayer. TG RERA looks at the relief you actually asked for.
Option A — Withdraw and seek refund
Use this when the project is abandoned, chronically delayed, unregistered when it should have been registered, or you no longer want the unit. Ask for:
Return of the entire amount paid (booking, instalments, GST if paid to the promoter, extra charges supported by receipts).
Interest under Rule 15 of the Telangana Real Estate (Regulation and Development) Rules, 2017.
A time-bound direction. Orders commonly give 30 days. Rule 16 speaks of 90 days from the date the refund becomes due — verify which clock the order uses.
Penalty under Section 63 if the promoter disobeys.
Option B — Stay and claim delay interest plus possession
Use this when the building is substantially complete and you still want the flat. Ask for:
Handover of lawful possession after occupancy certificate.
Execution and registration of the sale deed against balance consideration that is actually due.
Delay interest from the day after the agreed possession date (including any grace period the agreement validly allows) until actual handover.
Completion of promised amenities recorded on the TG RERA project page.
Option C — Compensation on top
Mental agony, rental loss, or other quantified loss is generally a Form N matter before the Adjudicating Officer under Sections 12, 14, 18 and 19 read with Section 71. Several TG RERA Authority orders expressly leave compensation to Form N. Filing only Form M for a large compensation claim is a common jurisdictional mistake.
Force majeure and COVID-period extensions are fact-specific. Promoters often plead pandemic orders or Section 6 extensions. TG RERA has accepted a limited exclusion in some files and rejected it in others where the agreement itself was signed after the pandemic window, or where the promoter produced no progress record. Do not assume a blanket holiday.
Authority (Form M) versus Adjudicating Officer (Form N)
Pick the form by the relief, not by habit.
| What you want | Forum | Form | Rule |
|---|---|---|---|
| Refund with Rule 15 interest, delay interest, direction to complete or register the sale deed, penalty for violation | TG RERA Authority, Hyderabad | Form M | Rule 34 |
| Compensation (and interest in that compensation inquiry) under Sections 12, 14, 18 and 19 | Adjudicating Officer | Form N | Rule 35 |
Form choice follows Newtech Promoters (2021). Confirm the latest Form M / Form N PDF on rera.telangana.gov.in before filing.
Both forms are published on rera.telangana.gov.in (forms page last refreshed around 24 February 2026 — confirm the latest PDF). Rule 34 and Rule 35 still mention a fee of one thousand rupees. Some secondary write-ups quote a higher Form N fee. Pay only the amount the live complaints portal demands and keep the receipt. Flag for human review: portal fee on the date of filing.
You do not need other allottees to join. One buyer can file on one agreement. An association of allottees can file for common defects or common amenities.
Unregistered projects and other forums
Section 3 registration is mandatory above the statutory threshold (generally more than eight apartments or more than 500 square metres — confirm the current exemption on facts). TG RERA has, in 2025–2026 orders, both directed refunds against unregistered promoters and imposed Section 59 penalties. If the land or building permission is outside Telangana, jurisdiction will fail.
Consumer commissions remain an additional forum after Imperia Structures. Section 79 bars civil courts on matters covered by the Act; it does not bar consumer fora. Do not run conflicting prayers in both forums without advice.
Documents That Actually Win Delay and Refund Cases
Build a single indexed PDF set before you open the portal.
Aadhaar / PAN and proof of address of every allottee named in the agreement.
Booking form, allotment letter, and registered or unregistered agreement for sale.
Payment trail: receipts, RTGS / NEFT printouts, home-loan disbursement letters, GST invoices.
Project RERA registration number and a screenshot of the official project page (completion date, extension, quarterly updates).
Sanctioned plan and brochure pages you rely on.
Emails, WhatsApp exports and legal notices demanding possession or refund.
Occupancy-certificate status, if any (HMDA / GHMC / local body).
Bank statement showing EMIs if you are paying a housing loan on a flat you do not have.
Calculation sheet: date-wise payments and the interest claim under Rule 15.
If a home loan is live, keep the lender in the picture. A RERA refund order does not automatically close the loan. The bank’s charge continues until the loan is prepaid or the bank is paid out of the refund.
Step-by-Step: TG RERA Complaint Filing in Hyderabad
Search the project on https://rera.telangana.gov.in. Save the registration number, promoter name, and registered possession / extension dates.
Decide Form M, Form N, or both on separate tracks. Write a short chronology: booking date, amounts paid, contractual possession date, grace period, present status.
Create a login on the dedicated complaints portal https://complaints-rera.telangana.gov.in (linked from the main site). Use an email and mobile you will keep for two years.
Fill complainant and respondent particulars exactly as they appear in the agreement and on the MCA / RERA page. Add every promoter entity and signatory you can identify.
State facts in numbered paragraphs. Quote the possession clause by date, not by memory. Attach the calculation of principal and interest.
Upload PDFs within the portal size limits. Name files clearly (01-Agreement.pdf, 02-Payments.pdf).
Pay the portal fee and download the acknowledgement. That complaint number is your proof of filing.
Watch the cause list on the same portals. TG RERA publishes separate lists for the Authority and the Adjudicating Officer.
On first hearing, be ready with originals or certified copies. If the promoter stays away, TG RERA has proceeded ex parte after paper publication and personal service — but only if your service record is clean.
Section 29 asks the Authority to try to dispose of matters within sixty days. In practice, Hyderabad files often run longer. Plan in months, not weeks.
How Delay Interest Is Calculated in Telangana
Rule 15 fixes the rate as the highest SBI MCLR plus two per cent. Recent TG RERA orders have used figures in the 10.70%–11.05% band depending on the then-prevailing MCLR. Recalculate on the MCLR published on the date of the order or as the order directs. Flag for human review: live SBI MCLR on the date of filing and on the date of order.
Two start dates appear in current Hyderabad practice:
From each payment date until actual refund — common where the buyer withdraws and the project is stalled (see August 2026 refund orders of the kind reported in the financial press, including the Lily Sahu-type files).
From the day after the promised possession date (plus any accepted grace or COVID exclusion) until handover or refund — common where the allottee stayed in the project for some time.
Do not invent a 12% or 18% contractual rate if Rule 15 applies. Promoters can claim reciprocal Rule 15 interest on your delayed instalments under Section 19(6) and 19(7), but only if they prove both the payment default and corresponding construction progress. A builder who collected money and stopped work rarely succeeds on that set-off.
After the Order: Compliance, Recovery and Appeal
If the promoter does not pay
Calendar the payment date in the order. If the promoter does not pay:
Apply for execution or recovery. Section 40 allows recovery of penalty, interest and the determined amount as arrears of land revenue through the District Collector.
Telangana amended the 2017 Rules in March 2025 (G.O. Ms. No. 60 dated 04.03.2025, inserting Rule 23(2) — verify current text) to let the Authority enforce orders in the manner of a civil-court decree, including attachment. Practice on this amendment is still settling. Ask the registry which execution path they are accepting on the date you file.
Non-compliance can attract a further Section 63 penalty.
Appeal — Telangana Real Estate Appellate Tribunal (TREAT)
Window: 60 days from receipt of the order (Section 44 read with Section 43(5)).
Form L, fee Rs 5,000 under Rule 25 (confirm live payment mode).
If the promoter appeals, the appeal is not heard unless the promoter first deposits at least 30% of any penalty, or the total amount payable to the allottee including interest and compensation, as the proviso to Section 43(5) requires. That pre-deposit is the buyer’s strongest practical protection.
Further appeal on a question of law lies to the Telangana High Court under Section 58.
A pending appeal does not automatically stay the refund. Stay has to be asked for and granted.
Common Mistakes That Sink Otherwise Strong Claims
Filing before the wrong bench (compensation-only prayer in Form M, or a simple refund in Form N).
Wrong possession date — ignoring a valid grace clause, or treating a marketing brochure date as the contractual date when the registered agreement says something else.
Incomplete payment proof; cash claims without a receipt.
Asking for possession and full refund in the same breath without an alternative prayer.
Ignoring your own unpaid instalments.
Accepting a “fit-out” or “symbolic” possession without an occupancy certificate and then finding it harder to exit.
Missing the 60-day TREAT clock.
Assuming a WhatsApp complaint to the builder substitutes a portal filing.
Forgetting the housing-loan account when the prayer is refund.
When to Consult a RERA Advocate in Hyderabad
File yourself if the facts are simple, payments are fully documented, and you only want statutory interest. Instruct a RERA advocate Hyderabad when:
The promoter raises force majeure, set-off, or “buyer default”.
There are multiple entities (landowner, developer, LLP, earlier promoter).
You need both refund and quantified compensation.
A home loan, SARFAESI notice, or CIRP against the company is running in parallel.
You must execute an unpaid order or defend a promoter appeal at TREAT.
The project is unregistered or the unit is claimed by a third party.
Bullet-Point Checklist
Confirm the TG RERA project number and saved portal disclosures.
Mark the agreement possession date and any grace period.
Add every payment with date, mode and receipt number.
Choose refund or delay-interest-plus-possession; draft compensation separately if needed.
Prepare Form M (Authority) and / or Form N (Adjudicating Officer).
File on complaints-rera.telangana.gov.in; save the acknowledgement and fee receipt.
Attend hearings; track the cause list and written orders.
On a favourable order, diary the payment deadline; if unpaid, move execution / Collector recovery.
If aggrieved, file a TREAT appeal in 60 days (promoter must pre-deposit).
Align any refund with prepayment of the housing loan.
Conclusion
A delay in flat handover in Hyderabad is not only a contractual grievance. Section 18 and Rule 15 give a clear, demand-based right to refund with SBI MCLR + 2% interest, or to delay interest if you keep the booking. File on the official TG RERA complaints portal with a clean payment trail, pick Form M or Form N according to the relief, and diary the 60-day TREAT appeal.
Statutory interest is predictable; compensation, execution and parallel loan issues are not. Get the prayer and the evidence right before you click submit.

Questions
How do I file a TG RERA complaint in Hyderabad?
Register on complaints-rera.telangana.gov.in, complete Form M or Form N, upload the agreement and payment proofs, pay the portal fee, and save the complaint number. The Authority sits at Masab Tank; hearings are notified on the cause list.
Can I get a full refund if the builder is only a few months late?
Section 18 allows withdrawal when the promoter fails to give possession as agreed. Short delay with a near-complete building is often met with delay interest rather than refund. Long stall, missing occupancy certificate, or no progress record supports refund. The order is fact-specific.
What interest will TG RERA grant on a builder delay refund in Telangana?
Rule 15: highest SBI MCLR + 2%. Recent orders have applied about 10.7% to 11.05% depending on the then MCLR. The start date (each payment versus promised possession date) varies by prayer and facts.
Is there a limitation period for a RERA delay complaint?
The 2016 Act does not write a limitation period into Section 31. Some High Courts (including a 2026 Chhattisgarh decision) have held the Limitation Act inapplicable to RERA complaints. Other benches still look at delay and laches. File as soon as the possession date lapses. Position to be verified on Telangana facts.
Should I go to TG RERA or the consumer commission?
Both are available. Imperia Structures holds that RERA does not shut consumer fora. RERA is usually quicker on registered projects and has a promoter pre-deposit on appeal. Consumer cases follow CPA limitation and a different fee structure. Do not run conflicting prayers in both forums without advice.
What if the builder ignores the TG RERA refund order?
Use Section 40 recovery as arrears of land revenue and the post-March 2025 execution mechanism under the amended State Rules (verify current Rule 23 practice). Ask for Section 63 penalty. If the promoter appeals to TREAT, insist on the Section 43(5) deposit.
Can I complain if the project is not RERA-registered?
Yes. Non-registration itself is a contravention if the project crossed the statutory threshold. TG RERA has ordered refunds and penalties in such files. Also consider a consumer complaint. Confirm land location and whether the small-project exemption applies.
Does a RERA refund cancel my home loan?
No. The loan contract is with the bank. Use the refund to close or regularise the loan, or the bank can continue recovery, including under SARFAESI if the account is NPA.
