Disputes Over Undivided Share of Land (UDS) in Hyderabad Apartments: Legal Rights
A practical guide for flat buyers, owners, associations, borrowers and litigants in Hyderabad and Telangana
Introduction
An undivided share of land in Hyderabad apartments is not a marked plot. It is your proportionate interest in the land on which the building stands. That share is what you resell, mortgage and bring to a redevelopment table years later.
Most buyers look only at carpet area and amenities. The fight later is almost always about UDS: the sale deed is silent, the square yards do not add up, the Sub-Registrar refuses the document, or the builder raises extra floors and sells more UDS than the land can carry.
This article explains what UDS is, how an undivided share calculation dispute is checked on paper, what a UDS land registration issue in Hyderabad looks like at the SRO, and what you can do when builder illegal construction UDS dilution is happening on the ground. The focus is Hyderabad and Telangana practice: TG RERA, GHMC / HMDA / municipal action, civil court, and the Telangana High Court only where a writ is genuinely needed.
Read this first. UDS is not a separate marketable plot you can fence. You cannot partition it like a house site while the apartment regime continues. What you can demand is a correct, registered share that matches the sanctioned land and the approved number of units — and a stop on extra floors that steal value from every existing owner.
What UDS actually means in a Hyderabad apartment
When you buy a flat, you buy two things that travel together: exclusive rights in the apartment, and a proportionate undivided interest in the land and common areas. The land is not cut into strips. Every owner holds a share in the whole.
In Hyderabad sale deeds the share is usually written in square yards. Agreements of sale also list carpet area, balcony, walls and common area. Banks and valuers treat UDS as a core title field. If it is missing, inflated or inconsistent with the parent land, a home loan and a later resale both stall.
Two statutes sit on top of the sale deed.
The Telangana Apartments (Promotion of Construction and Ownership) Act, 1987 (adapted for Telangana) treats the apartment plus its undivided interest as heritable and transferable immovable property. The percentage of undivided interest cannot be partitioned or separated from the flat unless the property is withdrawn from Chapter III. That Chapter applies only if a Declaration is executed and registered. Many Hyderabad buildings never file one. Check before you rely on Chapter III rights.
The Real Estate (Regulation and Development) Act, 2016, read with the Telangana RERA Rules, 2017, requires the promoter to execute a registered conveyance of the apartment and to transfer the undivided proportionate title in the common areas to the association of allottees or the competent authority (Sections 11(4)(f) and 17). Where no local law fixes a different window, the conveyance is to be done within three months of the occupancy certificate.
How UDS is calculated — and where the dispute starts
There is no single central circular that every Hyderabad SRO uses as a calculator. In practice, builders and valuers use a proportionate formula:
UDS of a flat = (area of that flat ÷ total area of all flats in the project) × total project land.
“Area” may be carpet, built-up or saleable, depending on the agreement. “Land” must be the land actually available after road widening, gift deeds to the local body, and any TDR-surrendered strips. If those deductions are ignored, every UDS figure on paper is inflated.
A simple check: add the UDS in every sale deed and agreement for the building. The total should not exceed the net plot. If 20 deeds each recite 55 square yards on a 1,000-square-yard plot, 100 square yards have been sold twice. That is an undivided share calculation dispute, not a drafting typo.
Worked example
Plot after setbacks and road-widening gift: 800 square yards. Sanctioned building: 16 identical flats. Honest UDS: 50 square yards each. If the builder then constructs four extra unsanctioned flats and registers 50 square yards for each of those as well, the paper UDS becomes 1,000 square yards against 800 on the ground. Existing owners have been diluted. New buyers have been sold a share the land cannot support.
Common UDS disputes in Hyderabad apartments
Sale deed silent or vague on UDS
Older buildings and some joint-development projects register only the built-up area. The land share is left unstated. Resale, bank mortgage and redevelopment then stall. The 1987 Act says the undivided interest is deemed to travel with the apartment even if the conveyance does not mention it — but only where that Chapter applies. Otherwise you fall back on the development agreement, the sanctioned plan and a civil declaration.
UDS land registration issue at the Hyderabad SRO
The Sub-Registrar may refuse the deed because the parent survey is on the Section 22-A prohibited list, the link documents do not cover the full extent, the landowner’s share under the JDA is already exhausted, or the UDS recited exceeds what the vendor still holds. A UDS land registration issue in Hyderabad is often a title-chain problem, not a stamp-duty problem.
Builder illegal construction that reduces UDS
Extra floors, merged flats, enclosed balconies shown as saleable area, and parking sold as independent units are the usual pattern. GHMC and other municipal bodies have been acting against unauthorised additional floors across west Hyderabad and older circles. Each extra unit that is sold with a UDS recital eats the land pool of the owners who already paid.
Common areas not conveyed to the association
RERA expects the promoter to convey undivided proportionate title in common areas to the association of allottees and to hand over plans and documents. Clubs, stilt, terrace, passages and open parking are frequently retained and monetised. That is a statutory default, not a “pending formality”.
Joint development / landowner share mismatch
In a JDA, the landowner’s constructed-area share and the developer’s saleable share must be mapped to UDS. If the developer sells the landowner’s share, or sells more than the developer’s entitlement, later buyers collide at registration. TG RERA has also treated area-share and revenue-share landowners who market units as promoters. Verify the current portal directions before you name parties in a complaint.
Parking, terrace and leftover land
Open and stilt parking generally sit in the common-area pool under RERA’s definition of common areas, subject to what the sanctioned plan actually shows as an independent garage. Selling “leftover” land or the terrace to a third party after flats are sold is a classic dilution move. Challenge it early; delay looks like consent.
Your legal rights, in plain terms
You are entitled to the UDS recited in your agreement and sale deed, so long as that figure is consistent with the sanctioned land and unit mix.
You are entitled to a registered conveyance of the apartment and to transfer of common-area title to the association under RERA Sections 11(4)(f) and 17.
The promoter cannot change the sanctioned plan, layout or specifications in a way that affects your allocation without the process RERA Section 14 requires. Extra floors after your booking are not a private bonus for the builder.
Misrepresentation of area, land share or approvals can support refund and compensation under RERA Sections 12 and 18, on facts.
You can ask the municipal body to stop and demolish work that is outside the sanctioned plan.
You can sue for declaration, injunction and, where the contract still needs performance, specific performance of registration of the correct UDS.
UDS is not a strip you can partition among co-owners while the building stands as an apartment property under the 1987 Act Chapter III.
Which forum to use in Hyderabad
Pick the forum by the relief you actually need. Filing everywhere at once is expensive and often contradictory.
| Forum | When it fits | Typical relief |
|---|---|---|
| TG RERA, Hyderabad | Registered or registerable project; promoter–allottee dispute; missing UDS registration; common-area handover; extra construction vs sanctioned or advertised plan | Direction to register, convey common areas, refund with interest, penalty; stop-sale style directions on facts |
| RERA Appellate Tribunal | Challenge to a TG RERA order | Appeal. Confirm current seat, limitation and pre-deposit from the live notification — to be verified. |
| GHMC / HMDA / municipal body / TS-bPASS | Builder illegal construction, extra floors, setback or FSI breach | Notice, stop-work, sealing, demolition; refusal to regularise what the building rules never permitted |
| Sub-Registrar / District Registrar | Deed refused; extent or 22-A mismatch | Reasons in writing. Correction only if title papers support it. 22-A deletion is not the SRO’s job. |
| City Civil Court / District Court | Title cloud, declaration of UDS, injunction against extra floors or third-party sale, specific performance, cancellation of a conflicting deed | Decree. Interim injunction under Order 39 if the three tests are met. |
| Consumer Commission | Deficiency in service against the builder for a buyer who qualifies as a consumer | Refund, compensation. Two-year limit from cause of action under the Consumer Protection Act, 2019. |
| Telangana High Court (Art. 226) | Statutory inaction, 22-A freeze, or a jurisdictional error — not a substitute for RERA or the civil court | Mandamus or certiorari in exceptional cases |
Civil court is generally the place for a pure title fight between two rival buyers of the same UDS. RERA is usually faster where the opponent is the promoter and the project is within the Act. A writ will not decide who owns 48 versus 52 square yards if evidence must be led.
Step-by-step: what to do when UDS is wrong or registration is refused
Collect the land paper trail: parent sale deeds, development agreement-cum-GPA, link documents, encumbrance certificate, approved plan, occupancy certificate, RERA registration certificate and the Form A / Form B disclosures.
Rebuild the UDS arithmetic. List every flat, its deed or agreement UDS, and the net plot. Note road-widening gift deeds and TDR surrenders.
Compare the building on site with the sanctioned plan. Photograph extra slabs, enclosed parking and merged units. An independent licensed surveyor’s sketch helps both RERA and the municipal complaint.
Issue a written notice to the promoter and, where relevant, the landowner-promoter. Ask for correction of the schedule, registration of the promised UDS, and a stop on further sales that exceed the land.
If the project is RERA-covered, file a complaint in the prescribed form before TG RERA with the calculation sheet and plan comparison. Seek a direction to register, to convey common areas to the association, and to restrain further illegal allotments.
In parallel, complain to the local town-planning office against unauthorised floors. Regularisation under the GHMC Act is not a right where the building rules themselves do not permit those floors. Telangana High Court has said so in extra-floor cases — verify the latest circle-level practice.
If the SRO has refused registration, take the written reasons. A 22-A block needs a Collector / competent-authority route, not an argument at the counter. A shortfall in the vendor’s remaining UDS needs a civil declaration or a corrected deed from the person who still holds that share.
Where a third party is about to buy the disputed share or the extra floor is being sold, move the civil court for an interim injunction. Delay is the usual reason injunctions fail.
Documents that actually matter
Registered sale deed and agreement of sale, with the UDS schedule highlighted.
Development agreement / GPA and any supplemental area-share deed.
Mother deed chain and latest encumbrance certificate for the survey number.
Sanctioned building plan, revised plan if any, and occupancy / completion certificate.
RERA registration, quarterly updates and advertisement / brochure that stated land or unit numbers.
A table of all flats versus UDS recited in each registered document.
Association registration, if formed, and any Declaration under the 1987 Act.
Municipal notices, stop-work orders, and photographs of extra construction.
Bank valuation / legal-scrutiny remarks if a loan was refused on UDS grounds.
Timelines and limitation — do not sleep on these
Limitation depends on the relief. Do not assume one clock covers every forum.
RERA complaint: file as soon as the default is clear (refusal to register UDS, extra floors, failure to convey common areas after OC). Do not wait for “the last tower”. Confirm whether any specific limitation practice is being applied by TG RERA on the facts — to be verified.
Consumer complaint: generally two years from the cause of action under the Consumer Protection Act, 2019. A sale deed in 2018 and a first protest in 2026 is often fatal unless a continuing cause is made out on documents.
Specific performance of a contract to convey UDS: three years from the date fixed for performance, or from refusal, under the Limitation Act, 1963 (Article 54).
Declaration: often three years from when the right to sue first accrues (Articles 58 / 113). Successive sales of the same land do not automatically reset the clock.
Recovery of possession / title against a person in adverse possession of land: twelve years in the ordinary Article 65 analysis. Apartment UDS disputes are rarely pure adverse-possession cases.
Municipal action against illegal construction is administrative. A pending regularisation application does not create a vested right to keep an illegal floor.
If you are already close to a limitation date, file the correct proceeding first and refine the pleading. Waiting for a “full set of certified copies” is a common way to lose the claim.
Common mistakes that weaken a UDS case
Paying the last instalment and taking keys without checking that the sale deed recites UDS in square yards and that the total of all deeds fits the plot.
Accepting a construction agreement only, with land left with the landowner “for later”.
Ignoring extra slabs because “GHMC will regularise”. Regularisation is discretionary and often unavailable for floors the rules never allowed.
Not forming an association. Common-area conveyance under Section 17 runs to the association. Individual letters are weaker.
Suing only the developer when the landowner is also a promoter or still holds the residual UDS.
Asking the SRO to “adjust” UDS without a supporting title document.
Delaying an injunction until the extra floor is occupied and sold to a bona fide purchaser.
Treating UDS as a partitionable site and filing a partition suit that the 1987 Act does not permit while Chapter III applies.
When to consult an advocate
The SRO has refused the deed, or the EC shows overlapping UDS sales.
Extra floors are going up and units are being marketed against the sanctioned plan.
Your brochure or agreement UDS does not match the sale-deed draft.
The builder will not convey common areas after the occupancy certificate.
A bank has flagged UDS or 22-A in legal scrutiny.
The association is heading into redevelopment and owners disagree on historic UDS.
Take the calculation sheet and the plan, not only the sale deed. The case is won or lost on arithmetic plus the sanctioned drawing.
Bullet-point checklist
Net plot area after gift / road widening / TDR surrender is known in square yards.
Every flat’s UDS is listed; the sum does not exceed the net plot.
Sale deed recites UDS, parking (as allotment, not a fake independent plot) and the survey number.
Approved plan floor count matches the building on site.
RERA registration exists if the project is above the statutory threshold (land over 500 square metres or more than eight apartments, subject to the Section 3 exemptions — verify on the facts).
Occupancy certificate date is diarised for the three-month conveyance window where local law is silent.
Association is registered or the statutory window to form one is running.
Parent survey is clear of Section 22-A on IGRS / Bhu Bharati.
Notice to promoter is out, with a calculation annexure.
Limitation for RERA / consumer / specific performance has been counted from the first refusal.
Conclusion
UDS is the land beneath your flat. In Hyderabad it is the number that decides resale, bank finance and the next redevelopment. An undivided share calculation dispute is solved with a spreadsheet and the sanctioned plan. A UDS land registration issue is solved by fixing the title chain or the 22-A entry, not by arguing with the clerk. Builder illegal construction that manufactures extra UDS is both a municipal offence and a civil / RERA wrong against every existing owner.
Do the arithmetic before the last payment. If the building is already up and the share is wrong, move while the extra floor is still a slab — not after it is occupied.
Disclaimer
This article is for general public information. It is not legal advice, a legal opinion, or a solicitation. Apartment UDS rights turn on the sale documents, the sanctioned plan, whether the 1987 Act Declaration was registered, whether the project is before TG RERA, and limitation on the particular facts. Building rules, RERA portal directions, stamp-duty practice and municipal regularisation windows change. Have a Telangana advocate verify the current position and the live IGRS / RERA / municipal record before you act.

If your Hyderabad sale deed is silent on UDS, the SRO has refused registration, or the builder is raising floors beyond the sanctioned plan, get the land arithmetic and the title chain reviewed before the next payment or the next slab. Bring the agreement, the sanctioned plan and the encumbrance certificate. A short written opinion at this stage is cheaper than a suit after the extra floor is sold.

Questions
What is UDS in a Hyderabad apartment sale deed?
It is your undivided proportionate interest in the land on which the apartment stands, usually written in square yards. It is not a demarcated site. It passes with the flat.
How do I check if my undivided share calculation is wrong?
Add the UDS in every registered deed and pending agreement for the same land. Compare the total with the net plot on the sanctioned plan and the mother deed. If the paper total exceeds the land, the calculation is wrong.
The builder constructed extra floors. Does that reduce my UDS?
If those floors are sold with their own UDS recitals, yes — the same land is being promised twice. Even without a new recital, extra load and extra claimants weaken your land interest and your redevelopment share. Municipal action and a RERA / civil restraint should run together.
The Sub-Registrar will not register my UDS. What next?
Take written reasons. If the block is Section 22-A, use the Collector / competent-authority deletion route. If the vendor has already sold the share, you need a corrected deed or a civil declaration against the person who still holds that interest. TG RERA can direct a promoter to complete conveyance in a covered project.
Can I file a partition suit for my UDS?
Generally no, while the apartment and its undivided interest remain under the 1987 Act Chapter III. The share cannot be separated from the flat. Partition of the land becomes relevant only if the property is lawfully withdrawn from that Chapter or the building is taken down for redevelopment under a fresh scheme.
Who should receive the common areas — me or the association?
RERA requires the promoter to convey the apartment to the allottee and the undivided proportionate title in common areas to the association of allottees or the competent authority. Individual owners do not take exclusive title to the club house or the stilt.
Is a consumer case enough, or do I need RERA and a civil suit?
Consumer relief is money and deficiency findings. It does not always clean title. RERA can push the promoter to register and hand over. A civil suit is still needed if two buyers claim the same square yards or if you need a decree against a third-party purchaser. Choose by the relief, not by habit.
Does GHMC regularisation fix a UDS problem?
No. Regularisation, where available at all, speaks to building permission. It does not create land that was never in the vendor’s title, and it does not authorise floors the building rules never allowed. Title and UDS arithmetic remain a documents problem.
