Property Dispute in Hyderabad: What Should You Do First?

The short answer
If you are in a property dispute in Hyderabad, the first step is not a speech at the police station and not a rushed injunction drafted from a template. It is to put four facts on the table:
- Which document do you rely on (sale deed, gift, partition, will, development agreement)?
- Who is in possession, and since when?
- What exactly is the threat today — a sale, a construction, a lock-out, a mutation?
- Which court or authority in Hyderabad or Medchal–Malkajgiri can actually grant the relief you want?
A police complaint does not decide title. A missing paper is a fact. Inventing a paper is a worse fact.
This article is general information for people in Hyderabad and Telangana. It is not an opinion on any pending suit and not a promise of any order. It is not a solicitation of professional work.
Who this is for
- a buyer or family member who has just discovered a second deed, a GPA sale, or a rival claim;
- a person in possession who has received a legal notice or a threat of dispossession;
- a person with a registered deed who is not in possession;
- anyone being told to “file an FIR first and see”.
If you already have a decree, an injunction, or a SARFAESI notice, those are different papers. Read them as they are. A SARFAESI notice is not a neighbour dispute.
What a “property dispute” actually is
In law, people use one phrase for several different fights:
| Kind of dispute | Typical question | Ordinary forum |
|---|---|---|
| Title | Who owns the land or flat? | Civil court (declaration / recovery) |
| Possession | Who is on the ground, and can they be removed? | Civil court (injunction / recovery of possession) |
| Record | Whose name is in revenue or municipal records? | Revenue / local body, then civil court if needed |
| Crime | Was there a cognizable offence? | Police / magistrate — only if the ingredients exist |
Mixing these up is how a Hyderabad file starts in the wrong room.
Step-by-step: what you should do first
1. Collect the papers, do not narrate them
Bring, if they exist:
- the registered sale deed, gift, partition deed, will, or development agreement;
- the link documents behind that deed (the earlier chain);
- the latest encumbrance certificate;
- revenue records (pahani / adangal, ROR, mutation) and GHMC or local-body tax receipts;
- apartment papers: sanctioned plan, occupancy, society or association records, GPA if any;
- proof of possession — electricity, water, rent, dated photographs taken in the ordinary course, keys, tenant records;
- any notice already received or sent;
- any prior suit, crime, or revenue proceeding on the same survey number or flat.
A title verification is this list done in order, not a stamp on a visiting card.
2. Write down possession as a fact
Courts in India protect possession as well as title. A person in settled possession is not in the same legal position as a person who holds only a deed. The Specific Relief Act, 1963 treats recovery of possession on title (Section 5) differently from the shorter possession action in Section 6 (generally to be filed within six months of dispossession). Which section fits is a legal choice. It is not a slogan.
Do not attempt a self-help eviction because “the deed is in my name”. That can create a criminal and a civil problem of your own. See illegal possession of property in Hyderabad.
3. Identify the immediate threat
A temporary injunction under Order XXXIX of the Code of Civil Procedure, 1908 is for an immediate risk — a sale, a construction, a change of possession — where you can show a prima facie case, balance of convenience and irreparable injury. It is discretionary. City Civil Court, Hyderabad and the District Court at Medchal–Malkajgiri list these applications as the diary allows. A lawyer who guarantees a same-day stay is not describing that diary honestly.
4. Check limitation before you check WhatsApp advice
The Limitation Act, 1963 uses different clocks for different claims (including, for many possession-based-on-title claims, a long period that still has to be counted from the right date). A late suit is not cured by anger. The date of dispossession, the date of the deed, and the date you first knew of the rival claim all matter. They must be taken from papers, not from memory.
5. Choose the forum, not the convenient building
Typical lanes in this city:
- City Civil Court, Hyderabad or the District Court, Medchal–Malkajgiri for civil title and possession, according to territorial and pecuniary jurisdiction;
- revenue authorities for mutation and record issues;
- the High Court of Telangana only for the writs and revisions the Constitution and the CPC actually allow — not as a first court of property;
- the police, only where a cognizable offence is made out.
Filing in the court nearest to your advocate’s chamber is not the same as filing in the court that has jurisdiction.
What not to do first
- Do not treat a family quarrel over ancestral land as a criminal case merely because it is bitter.
- Do not send a legal notice that admits a fact you will later need to deny. See how to reply to a legal notice.
- Do not pay anyone to “settle the survey number” off the record.
- Do not rely on an unregistered GPA / SA / will arrangement as if it were a conveyance. The Supreme Court in Suraj Lamp & Industries Pvt. Ltd. v. State of Haryana (2012) 1 SCC 656 made clear that such transactions do not transfer title in immovable property.

Questions
What should I do first in a property dispute in Hyderabad?
Collect every deed and revenue paper you have, write down who is in possession and since when, and then identify the civil court or other forum that can actually grant the relief you want. Do not start with a police complaint for a pure title fight.
Does a registered sale deed prove I own the property?
No. Registration proves that that particular deed was executed and registered. It does not prove that every earlier link in the chain is sound, or that nobody else is in possession or in court.
Can the police settle a property title dispute?
The police investigate crime. They do not try title. Where the quarrel is about ownership, possession or a document, the civil court is ordinarily the forum. A cognizable offence is a different question, on different ingredients.
How fast can I get a stay on construction or a sale?
There is no guaranteed time. A temporary injunction under Order XXXIX of the CPC depends on a prima facie case, balance of convenience and irreparable injury, and on how the court lists the application. Nobody can honestly sell a same-day stay.
